SACRAMENTO (CBS13) – Police say that the parents of an infant that was rushed to the hospital and later died have been arrested on child abuse and neglect charges.

The 3-month-old boy was taken to the hospital back on July 24, according to the Sacramento Police Department. Police say that a Sacramento Fire Department crew had been called to an apartment along the 2900 block of North Meadows Drive that day to come to the aid of the infant.

The infant was first taken to a nearby hospital, but was then transferred to the UC Davis Medical Center due to his critical condition.

Detectives soon started their investigation and interviewed the infant’s parents – 27-year-old Ashleigh Smith and 19-year-old Terry Scott. Both Smith and Scott were booked at Sacramento County Jail later on July 24 on felony child abuse and neglect charges.

Police say that at 11:45 a.m. Saturday, the infant died.

Father accused of 3-year-old son’s murder: “I threw him in the garbage can”

MEMPHIS, Tenn. — The man accused of murdering his 3-year-old son took the witness stand Saturday morning, sharing a very different version of events than he has before.

Maurice Brown said he chased his son, Maurice Brown, Jr., around the house and repeatedly beat him after he got bath water on the floor.

Brown said his son hit his head a number of times and was knocked unconscious when he slipped on the bathroom floor.

“I saw his eyes roll in the back of his head, but he came, he came back,” said Brown.

He said he thought Junior was asleep and put him on the bed, but later realized he wasn’t breathing.

Brown said he then put Junior and another son in his car and was headed to the hospital, but panicked. He then pulled into an alley and thought about how Junior’s mother was going to react.

“I threw him in the garbage, can
and felt like when he was out of my presence a big relief,” said Brown.

Brown then called 9-1-1 and said Junior walked out of the house. He admitted to lying to detectives and reporters about what happened to his son.

He added he didn’t kill his son, he just messed up.

Friday, the medical examiner used graphic autopsy photos and diagrams to show injuries to Junior’s body. She said he bled to death internally from a laceration to the liver. He also had numerous bruises, broken ribs and bleeding on the brain.

The defense tried to convince the jury that Junior got some of the injuries from the spanking, and some from running around the apartment and hurting himself.

It’s a theory the prosecution found impossible, especially after asking the chief medical examiner, who said said Junior couldn’t have caused the fatal injuries himself.

If found guilty, Brown faces life in prison.

TAMPA, FL (WFLA) -

Austin Hamilton, accused of murdering his girlfriend's 1-year-old baby, will have his first appearance in court Monday.

Officers arrested Hamilton Sunday. The 24-year-old was supposed to be taking care of the baby and his 6-year-old brother at the Motel 6 at 333 East Fowler Ave. in Tampa, when his girlfriend went to work Saturday.

Later on that night, Hamilton called 911 for help when the baby, Sincere Williams, was having trouble breathing. The child was taken to St. Joseph's Hospital, where he later died.

At first, Hamilton claimed he didn't hit the child. After detectives told him that the Medical Examiner's Officer report said the child died from blunt force trauma to the lower abdomen, Hamilton changed his story.

Hamilton told officers, he "lost control" and hit the victim several times all over his body with a leather belt, the police report said. He went on to state that while he was disciplining the child, he tried to pick the victim up, but the child fell and hit his head.

YPSILANTI TWP. (WWJ/AP) - A 20-year-old Ypsilanti Township man will spend the rest of his life in prison for killing his 4-month-old daughter.

Davontah Nelson was sentenced earlier this week in Washtenaw County to life without the possibility of parole for the felony murder of Amareah Nelson last October.

Nelson will concurrently serve 15 years for first-degree child abuse. Both are the maximum sentences.

Medical personnel responded to Nelson’s home after he called for help, and found his daughter Amareah unresponsive. According to investigators, Nelson was the only adult home with Amareah and his other child, an 18-month-old who was uninjured.

Shortly after being treated at the hospital, Amareah was pronounced dead due to her injuries, which included a fractured skull, lacerated liver, retinal hemorrhages and fractured ribs.

Mpls. Couple Charged With Murder In Infant Daughter’s Death

MINNEAPOLIS (WCCO) – Thirty-nine-year-old Cardie Jackson and 40-year-old Shonwta Jackson were charged with second-degree murder Tuesday in Hennepin County Court in the death of their 6-week-old daughter.

Hennepin County prosecutor Amy Sweasy says the baby suffocated in a laundry basket filled with blankets and a pillow, where she regularly slept.

“Cases that involve the negligent acts of parents that result in significant harm or death are the saddest things we see, because they are by definition preventable,” Sweasy said.

She said that last March the couple was partying at their Minneapolis apartment, and they put the baby to sleep in the laundry basket.

Sweasy said a nurse had given the couple information warning against including pillows or loose bedding in a sleep environment.

“If both parents would have made a series of different choices, this baby would be a happy baby now,” she said.

Police say the baby was the couple’s 11th child. :rolleyes:They had lost custody of nine children and a 2-year-old is in foster care.

“The parents chose to drink, the parents chose to disregard the advice of the visiting nurse. Miss Jackson chose to put the baby face down on or her side. We know that, because that’s how the baby was found,” she said.

Sweasy said it’s taken this many months for the charges to be filed, because the case involved an infant, and there were no obvious signs of distress.

They also had to verify the child was that of the father.

INDIANAPOLIS - An Indianapolis man has been charged with murder in the death of his 4-year-old son.

Dennis Price, 29,
called police to his home in the 900 block of East 42nd Street on Saturday night, telling dispatchers his son took pills and was unconscious and not breathing.

The boy was later pronounced dead at the hospital.

A doctor at the hospital told police the boy had "multiple areas of blunt force trauma over his entire body," and he had blood in his stomach and chest and marks on his head.

When police took Price in for questioning, he told detectives he had been whipping and punching his son in the days leading up the boy's death.

According to court documents, Price told police he gave the boy ibuprofen to reduce the swelling, then -- worried that he'd given him too much -- tried to make the boy vomit by having him drink a cup of water with a charcoal briquette in it.

An autopsy determined the boy died of blunt force trauma, and the boy's death was ruled a homicide.

CHATTANOOGA, Tennessee(WDEF) - A man who was accused of severely beating a 3-year old girl then taking her to the hospital is now facing additional charges.

Rhasean Lowry, 34, is now facing a charge of criminal homicide to go along with the original charge of child abuse and assault.

According to officials at Children's Hospital, the child died two days after she was admitted.

The investigation began when the victim showed up unconscious at a local emergency room.

Lowry told investigators that the child fell down some stairs at motel but forensic investigators found bruising all over the child's body that was not consistent with Lowry's story.

The alleged abuse reportedly occurred at the Econo Lodge on Bonnie Oaks Drive where Lowry, his girlfriend and her three children reside.

Investigators reviewed motel surveillance video of Lowry placing a limp and lifeless body into his vehicle. He was reportedly taking the child to Parkridge Hospital.

The Oklahoma City Police Department said a stepmother was arrested this week after her two-year-old stepson was found dead.

Kindell Adair, 33, was arrested by police after they were called to a home Wednesday morning to a report of a child not breathing.

According to the police report, they were called to a home in the 2300 block of SW 23rd Street. Police say the caller said a 2-year-old was not breathing. When police and fire departments arrived, they confirmed the child had died.

Adair said she put the child to bed at 8:00 p.m. the night before but the child then threw up two hours later. Police said Adair cleaned it up and changed the child's diaper. That's when Adair said the child fell and hit his head. She said she kept him awake to make sure he was okay and then went back to bed at 10:45.

The report states the boy slept on an air mattress with another child in the home and was found face down and not breathing.

Investigators said they interviews Adair and other family members at the scene. They say they determined through the interview that they had probable cause to arrest her on suspicion of child abuse.

Fort Bliss soldier arrested on suspicion of beating child to death

A 20-year-old Fort Bliss soldier was arrested and charged with capital murder for allegedly beating his 2-year-old daughter to death Saturday in a Central El Paso apartment because the girl soiled her diaper, El Paso Police reported Sunday.

20140921_074656_0922_NWS_EPT_L_BABY%20DEATH%201_ML_VIEWER.jpg

Dartarious Graham, 20, was charged with capital murder and booked into the El Paso county jail on a $250,000 bond, police reported.

He is an U.S. Army specialist stationed at Fort Bliss and assigned to the 1st Armored Division. Fort Bliss is cooperating with El Paso police, who retain jurisdiction in this case, Army Lt. Col. Lee Peters, a Fort Bliss spokesman, reported in an email.

20140921_074713_0922_NWS_EPT_L_BABY%20DEATH%202_ML_VIEWER.jpg
20140921_074724_0922_NWS_EPT_L_BABY%20DEATH%203_ML_VIEWER.jpg

The child's mother, Elizabeth Graham, 23, who police said was not in the apartment at the time of the beating, but reportedly knew of earlier abuse to the child, and the father's cousin, Robert Franklin, 19, who allegedly witnessed the beating, also were arrested and charged with injury to child by omission.

The child, Peyton Graham, was pronounced dead after being taken to El Paso Children's Hospital by an El Paso Fire Department unit called to an apartment at 4011 Alabama at just before 5 p.m. Saturday. The fire unit team found the child unresponsive, police reported.

Police were called to the hospital after the child died because the injuries appeared suspicious.

Dartarious Graham allegedly beat his daughter with a belt after she had soiled her diaper, reported police Det. Mike Baranyay, a police department spokesman.

The police investigation, along with older bruises on Peyton Graham's body indicated the father had beaten the child other times, Baranyay said. However, Baranyay said he was unaware of any previous reports being filed with the police regarding abuse to the 2-year-old.

The mother was arrested because she allegedly was aware of the earlier abuse and failed to report it to authorities, he said.

Franklin reportedly heard Dartarious Graham beating the girl in her bedroom, and later witnessed him beating the girl when the father took her to another room, and did not try to stop the beating or call police, Baranyay reported. Franklin called the 911 emergency number after the girl was beaten, Baranyay said.

In the state of Texas, all adults must take steps to protect a child who is being abused, or report child abuse they know about, Baranyay said. That is why Franklin also was arrested.

"What we have to remember is there are options" when people know a child is being abused, Baranyay said. "And there's options in getting the help to the family. That can be simply calling the police, that can be contacting a counselor the family may have available to them, or contacting another family member.

"But in these cases, where you're actually seeing the child being physically beaten, and your capable of physically intervening, I think you have some responsibility to step forward and do that," he said. "At the minimum you need to call the police."

Elizabeth Graham's bond was set at $20,000, and Franklin's bond was set at $5,000. They and Dartarious Graham were still in County Jail Sunday evening.

The Grahams' reportedly have another child. But Baranyay said he did not know where the boy is now, or if he had been in the apartment at the time of the alleged beating.
