Six months after her first capital murder trial ended in a mistrial, Arnold's case returns to Montgomery County Common Pleas Court.

Arnold, 28, is known across the Dayton region and beyond as the woman accused of killing her 3-week-old daughter
in a microwave oven. Charged with aggravated murder, she could receive the death penalty if convicted.

Much will be the same as in the first trial. Jury selection will start Monday and continue for several days. Witness lists and subpoenas show many of the same witnesses that appeared in the first trial.

There are two notable exceptions: a boy and his father, who came forward during the trial and whose statements led retired Judge John Kessler to declare the mistrial, have been subpoenaed by Arnold's defense attorneys.

The boy's father told the Dayton Daily News in February that he called Arnold's attorneys Feb. 4 after his son said he had been present when Paris Talley was killed and had pulled the baby's body from the microwave. The father said his son told him an older child might have put the baby in the microwave.

The boy's mother told prosecutors the boy was not at Arnold's home when the baby died.

There will be another new player in the second trial: Montgomery County Common Pleas Judge Mary Wiseman, appointed to the bench last year by Gov. Ted Strickland, will preside over the case.

Wiseman will be the third judge to which the case has been assigned. It went first to Judge G. Jack Davis, who died in March 2007, it was then transferred to Kessler.

Kessler retired in October and transferred his docket to the next judge. Because the selection would take some time, and the appointed replacement would have to undergo training, Kessler agreed to hear two murder cases after his retirement: Arnold's and one that was tried in December.

Following the mistrial, Kessler recused himself from the case citing unspecified information he received in closed hearings. The day of the mistrial, Kessler conducted closed hearings with several witnesses, including the boy who had come forward and his father.


So the case returned to the docket of Kessler's replacement. By that time, Wiseman had been appointed. She has since been trained in conducting capital cases.

Wiseman has kept many of Davis and Kessler's safeguards regarding pretrial publicity. The attorneys are still under a gag order, unable to speak publicly about the case. The documents in the case file remain unavailable from the clerk of courts online imaging system.

Media access will also be somewhat limited, as in the first trial, local television stations sharing images from a single camera.

But Wiseman said two weeks ago that she did not plan to use the metal detectors outside of the courtroom, as Kessler did, because it slowed down spectators as they returned from breaks. Everyone who entered the court building must go through a metal detector downstairs, and the sheriff's deputies can put up the metal detector again should there be a need, Wiseman said.

The young relative also told friends that he hadn't been lying about the death when prosecutors later announced a microwave was used in the 2005 death, defense attorney Jon Paul Rion said.

"I know who killed that baby," the cousin had said days after the death, Rion told jurors.

China Arnold, 28, is being retried on charges that she killed Paris Talley by burning her in an oven. Arnold has pleaded not guilty to a charge of aggravated murder. She could face the death penalty if convicted.

Judge John Kessler declared a mistrial February 11 after he privately heard testimony from a juvenile who said he was at Arnold's apartment complex the night the baby died. The judge declared the mistrial just as closing arguments were to begin but did not reveal what the ju
venile said.

The Dayton Daily News later reported that the mistrial came after a man told defense attorneys that his 5-year-old son identified an older child as the person who might have put the baby in the oven, saying the older child had a history of putting cats and dolls into microwaves.:lol::lol:

Prosecutors said evidence will show that Arnold was responsible for her daughter's death. Their case will include testimony from a former cellmate of Arnold who claims Arnold confessed to her and described putting the child in the microwave.

"'She fit right in.' :tongue: Those are the words of this defendant," said Dan Brandt, assistant Montgomery County prosecutor.

Arnold has offered too many different accounts of what happened that night, Brandt told jurors.

But Rion argued that Arnold couldn't remember what happened and was probably too drunk that night to have put the infant in the oven. There were also varying accounts from others of the events of that night
, he said.

"She's not lying," Rion said. "She's simply trying to put the pieces of the evening together." :rolleyes:

The argument got so furious that Arnold bit her boyfriend's lip and he slapped her, Brandt said.

Arnold later told a cellmate she put the baby in the microwave and turned it on because she was worried her boyfriend would leave her if he found out the child wasn't his, Brandt said.

In rebuttal, however, the 8-year-old's mother testified Wednesday that they lived some distance away and they were not at Arnold's apartme

Her former live-in boyfriend also testified that he was certain the boy was not at the location.

The defense had argued that Arnold was drunk when the crime occurred and that she had no motive. Prosecutors called the crime "heinous."

China Arnold's bid for a third trial was rejected by Montgomery County Common Pleas Court Judge Mary Wiseman.

Arnold, 28, of Dayton, was convicted of aggravated murder in August for the 2005 death of Paris Talley and sentenced in September to life in prison without the possibility of parole.

Prosecutors said Arnold intentionally put the baby in the microwave oven after a fight with her boyfriend. They said the couple had argued over whether the boyfriend was the biological father.

Arnold, who denies killing the baby, has filed a notice of appeal of her conviction.

During Arnold's first trial, cellmate Linda Williams testified that Arnold admitted she put the baby in the microwave.

During a hearing last month on Arnold's motion for a new trial, Williams said she falsely testified that Arnold confessed because she was afraid of prosecutors and police and really doesn't remember what Arnold said.

Two juveniles testified during the hearing that another person confessed to putting the baby in the microwave. The juveniles later recanted their statements and then recanted their recantations.

In her ruling, Wiseman wrote that neither juvenile was credible. She added: "Williams' recantation is so incredible that it cannot form the basis for a third trial."

Defense attorney John Rion said the goal was to give the judge the chance to revisit issues brought up during the trial.

"We felt it necessary to make a record of these matters so that the court of appeals would be in a better position to review them," Rion said.

An Ohio woman who was convicted of 'cooking' her month old baby to death in a microwave had the ruling dramatically reversed today.

China Arnold, was sentenced to life in prison without parole in 2008 for killing 28-day-old Paris Talley in August 2005.

But the 2nd District Ohio Court of Appeals in Dayton ruled that the woman should be freed.

Defence attorney Jon Paul Rion said today that he's thrilled with the ruling and said he 'realised from the first day' that Arnold was innocent.

The 30-year-old continued to deny killing her baby after going through two trials in the case.

The first ended in a mistrial and she was sentenced following her second trial.
Montgomery County prosecutor's office spokesman Greg Flannagan said prosecutors were reviewing the ruling before commenting.

The conviction was apparently reversed based on prosecution misconduct and claims that they hid witnesses, disobeyed court orders and subverted the judicial process according to Mr Rion.

The state's star witness Linda Williams also recanted her story. After Arnold was convicted, Ms Williams came forward and said that she lied to the jury about the mother confessing that she put her daughter in a microwave oven.

In September 2008, Arnold was spared the death penalty when the jury deadlocked during the sentencing phase after her conviction on aggravated murder.

Arnold had a criminal past and was convicted of abduction in 2000 and forgery in 2002.

She had lived with her children and her boyfriend Terrell Talley at the time of the baby's death.

Prosecutors said that Arnold placed Paris into the microwave after an argument with Talley over the baby's paternity. She told investigators that she was intoxicated.

Arnold took Paris to the hospital the following day but she succumbed to her injuries.

Arnold was initially arrested but then released due to lack of evidence. She was re-arrested in November 2006.

The death was ruled a homicide caused by hyperthermia, or high body temperature. The absence of external burns ruled out an open flame, scalding water or a heating pad as the cause.

Arnold and the child’s father had apparently gone out for a short time and left Paris with a babysitter, Rion said.

The mother didn’t sense anything out of the ordinary until the next morning, when the child was found unconscious.

Mr Talley had later claimed that his son told him he had pulled the baby's lifeless body out of the microwave after a neighbour's boy had put her in there. This claim resulted in a mistrial.

However at the second trial, the mother of the boy in question managed to prove that he was not at the residence when baby Paris died and Arnold was convicted of murder.

Arnold's mother Gloria Scott said today that she was very happy when she learned the appeals court had reversed her daughter's murder conviction.

'I was so overjoyed. It was so unbelievable', Ms Scott said at a news conference.

She said she was sure her daughter would be freed and said to co-workers: 'I told them that China is coming home'.

Arnold will be back in Montgomery County in a few days and once she returns will be held in Montgomery County jail pending a bail hearing. She is now expected to be granted a new trial.

Cases like this remind us that even in the absence of proper weapons and armaments, niggers will use even common household objects as tools for killing and maiming. Anyways, I saw the newest story on Frontpage and got the wrong impression it might be the same case, dragged out as cases usually are. China Arnold has her own Wikipedia page.

At age 19 or 20 she abducted 'someone' unknown, then Forgery in 2002.

Her boyfriend, the supposed father, Terrell Talley accused China of having an affair, but Terrell was cheating on her with their next door neighbor.

Case​

Murder of Paris Talley​

On August 30, 2005, when China Arnold and her children lived with her boyfriend, Terrell Talley, in a housing complex in Dayton, Ohio, there was an argument over Paris's paternity. They got in a fight and her anger turned into violence, after which 28-day-old Paris was placed in a microwave for two minutes. She then removed the baby and put her on the table. Paris had died within seconds due to the heat.[2][3] Medical experts said the baby died after her temperature reached 107–108 °F (41.7–42.2 °C). She had no external burns but did suffer high-heat internal injuries.[4]

Finding Paris cold and stiff with burn marks on her body the next day, her parents took her to the hospital where she was pronounced dead.[5] Arnold told investigators that she had been intoxicated.[6] John Paul Rion, the attorney who represented Arnold at her first trial, said she was intoxicated to the point of blacking out when the child died.[4] Arnold had been convicted of abduction in 2000 and forgery in 2002.[7]

Arrests​

Arnold was arrested and subsequently released due to a lack of evidence. She was rearrested in November 2006.[3]

Trials​

While in jail awaiting trial, Arnold became sexually involved with her cellmate, Linda Williams, who later testified that Arnold confessed her guilt to her.[5]

First trial​

Shortly after Arnold's first trial began in February 2008,[4] Talley said his son had told him that he pulled Paris's lifeless body out of the microwave after a neighbor's boy had put her inside,[8] and the judge declared a mistrial.[9]

Second trial​

During the second trial, the mother of the child said to have placed the baby in the microwave testified that her significant other was not at the housing complex when Paris died[relevant?], and Arnold was convicted of aggravated murder and sentenced to life in prison without the possibility of parole on September 8, 2008. She was incarcerated at the Dayton Correctional Institution.[10]

On November 5, 2010, the Ohio Second District Court of Appeals reversed Arnold's conviction, citing prosecutorial misconduct, and stated that the court erred by not allowing material witnesses to testify in her defense.[11]

Third trial​

On May 13, 2011, a jury found Arnold guilty of aggravated murder. Her attorney had argued that the evidence pointed as much to Talley as it did her, but failed to convince the jury.[12] On May 20, Arnold was again sentenced to life in prison without parole, with both the jury and judge rejecting the death penalty option. Her attorney said they would appeal the decision.[13]

In September 2013, Arnold's lawyer requested a new trial in the Second District Court of Appeals, claiming multiple errors were made in her case.[4] In December 2013, the 2nd District Court of Appeals affirmed the conviction. An appeal regarding her life sentence was made citing constitutional questions about double jeopardy, asking the Ohio Supreme Court to reverse the 2nd District Court of Appeals decision and send the case back to the trial court "for re-sentencing", but in May 2014, the Court decided not to take up the appeal.[14]
