California Sen. Kamala Harris, one of the top contenders to be Joe Biden’s VP choice has a major scandal on her hand.

The senator was an outspoken critic of former Labor Secretary Alex Acosta for the plea deal he made with convicted pedophile Jeffrey Epstein.

But now it appears that Harris, when she was a prosecutor, made a similar deal when 20 women accused a politician of sexual misconduct, Fox News reported.

Democratic presidential candidate Kamala Harris is facing questions over a plea deal her office negotiated during her stint as California’s attorney general that allowed a disgraced former San Diego mayor to avoid registering as a sex offender and dodge prison time.

Harris’ office was reportedly in charge of negotiating a plea deal stemming from allegations of sexual harassment and misconduct against former San Diego Mayor Bob Filner brought by about 20 women in 2013.

According to the Washington Examiner, Harris’s office drew backlash for letting Filner plead guilty to state charges of false imprisonment and battery against three women in exchange for a light sentence.

“The cultural change since #MeToo is having an impact of how prosecutors listen to victims now. I think it all comes down to whether we believe women and how seriously we take these allegations.

“In serious instances, you need serious consequences,” National Women’s Law Center Maya Raghu, director of workplace equality and senior counsel at the National Women’s Law Center senior counsel said.

“Powerful people can afford high-profile legal counsel that others don’t have access to. People [such as Filner] know how to leverage the system in their favor,” she said.

But a spokesman for her former presidential campaign said that her plea deal, unlike what she accused Acosta of, empowered women.

“She prosecuted a politician from her own party for sexual harassment, and he pled guilty to a felony,” the spokesperson said.

“She was broadly praised for taking action, including by the Republican San Diego County district attorney who said it sent ‘a strong message that nobody is above the law, abuse of women won’t be tolerated and victims will be treated with respect.'”

It was just a few short months ago when Sen. Harris appeared on the ABC Daytime talk show “The View” and complained about how the Epstein case was prosecuted.

“I personally prosecuted child sexual assault cases. And they are some of the most difficult cases to prosecute,” she said.

“The thing I found so troubling, disheartening and really unbelievable was the way that Acosta has described the challenge … It’s like saying it’s really difficult to make an omelet … Well, then get out of the kitchen!”

That is good advice that the former prosecutor should take. She wanted Acosta to resign and he did, will she do the same and cancel her shot at the VP slot?

Sen. Kamala Harris (D-Calif.) said last year that she believed the accusations of several women who claimed Democrat presidential nominee Joe Biden sexually assaulted them.

Harris, who has just been selected as Biden’s running mate, said in April 2019 that she believed several women who had come forward alleging that Biden touched them inappropriately.

“I believe them and I respect them being able to tell their story and having the courage to do it,” Harris said at a presidential campaign event in Nevada.

Harris was referring to accusers Caitlyn Caruso and D. J. Hill, who said in a New York Times piece that Biden molested them.

Former Democrat Nevada legislator Lucy Flores also had accused Biden of touching her inappropriately during a campaign event in 2014, which she said was “disqualifying” for Biden to run for president.

“I felt him get closer to me from behind. He leaned further in and inhaled my hair. I was mortified. I thought to myself, ‘I didn’t wash my hair today and the vice-president of the United States is smelling it. And also, what in the actual ****? Why is the vice-president of the United States smelling my hair?'” Flores wrote in an op-ed detailing her encounter with Biden.

Perhaps the most explosive accusation came from Biden’s former staffer Tara Reade, who accused Biden of penetrating her with his finger in 1993, a claim that was taken seriously by the likes of “woke” celebrities like HBO host John Oliver.

So did Harris lie when she said she believed Biden’s accusers, or is she choosing to support a pervert now that she’s his vice presidential pick?

It’s likely Harris simply does not care one way or the other, as many on the left defended Biden’s propensity for groping women and girls, claiming he was just “showing affection.”

Far-left radical Rep. Ilhan Omar (D-Minn.) said she’d vote for Biden even if Reade’s accusations were true.

US Senator Kamala Harris (D-CA) was tapped on Tuesday to be Joe Biden’s vice presidential running mate on the Democratic ticket in the November 2020 election. Harris’ political history extends back to 2003.

Born in Oakland, California, in 1964 to an Indian doctor mother and Jamaican economist father, Harris entered school during the lengthy process of racial desegregation, a process she told Biden last year had greatly affected her political perspective.

Harris studied political science and economics at Howard University in Washington, DC, during which time she participated in political demonstrations against the apartheid regime in South Africa and interned as a mailroom clerk for California’s then-senior senator, Alan Cranston, who was in the midst of his own failed bid for the presidency in 1984. She then returned to California to study law at the University of California, San Francisco, passing the bar in 1990 and going to work as a deputy district attorney.

In 2003, Harris was elected district attorney of San Francisco, where she served until 2011, when she was elected on a “tough-on-crime” platform to become attorney general of California - the state’s “top cop,” as she once quipped.

As a district attorney and attorney general, Harris pushed for higher bail for criminal defendants accused of violent crimes and backed the “three strikes” rule mandating life sentences for third-time criminal offenders, but also firmly opposed the death penalty and never sought it in a case, even when public outcry favored it. However, she also backed initiatives aiming to ease the reintegration of former convicts into society after leaving prison.

Her record on LGBTQ right is mixed: although as district attorney she backed LGBTQ hate crime investigation units and has become known for the transgender-inclusive practice of stating her pronouns on the presidential campaign trail, she also supported policies that put trans women in men’s prisons and fought against a trans woman prisoner who sued for her right to receive gender-affirming surgery.

During the controversial era of Proposition 8, which re-illegalized same-gender marriage in California, Harris notably refused to recognize the amendment, which was soon struck down by state courts. She also co-sponsored the Equality Act, a bill that seeks to ban anti-LGBTQ discrimination nationwide.

Harris has a 100% approval rating by the abortion rights advocacy group Planned Parenthood Action Fund and an “F” rating from the National Rifle Association (NRA), indicating her strong support for the right to an abortion as well as restrictions on gun ownership.

While she has defended her record as California attorney general in prosecuting the Latino gangs often invoked by Trump as justification for his anti-immigration policies, Harris has also supported the DREAM Act and condemned the Trump administration’s policies of family separation and deployment of US troops to the Mexican border.

Harris is also a strong supporter of net neutrality, consumer protections and the continued nationalization of the US Postal Service, as well as the Medicare-for-All universal health care policy popularized by Sen. Bernie Sanders (I-VT). She also voted against the US-Mexico-Canada Agreement (USMCA) trade deal and for the 2021 National Defense Authorization Act (NDAA).

Harris is also a strong proponent of “Russiagate,” especially the notion that Russian hackers are stirring up dissent in the US via viral social media campaigns, such as the outrage over professional football player Colin Kaepernick taking a knee in protest during the US national anthem before games.

US Senator and Presidential Hopeful

In 2016, Harris defeated Republican incumbent Senator Loretta Sanchez to become California’s junior representative in the US Senate. As such, Harris was only the second Black woman and the first South Asian-American woman to serve in the upper chamber of the US Congress.

As a US senator, Harris sits on the Senate’s Judiciary, Intelligence, Homeland Security and Budget committees. In 2017, she traveled to Iraq to visit US troops there and also visited the Syrian Zaatari refugee camp in Jordan, and in 2018, she traveled to Afghanistan as part of a congressional delegation and received briefings and “met American service members, diplomats and national security professionals,” according to her office.

As senator, Harris has strongly opposed US President Donald Trump’s appointments to various political offices, including department heads and US Supreme Court justice nominees. However she has, generally speaking, supported the foreign policy of the Trump administration, especially in its more aggressive tendencies against Venezuela, North Korea, Russia, Syria and China, though she criticized Trump’s departure from the 2015 Iran nuclear deal.

She has spoken at the American Israel Public Affairs Committee (AIPAC) lobbying group’s annual convention every year of her senatorship. Harris has been described as “a lifelong supporter of Israel,” has celebrated the Israeli annexation of East Jerusalem and opposes the Boycott, Divestment and Sanctions (BDS) movement, though she also supports a two-state solution.

Harris was also one of Biden’s competitors for the Democrats’ 2020 presidential nomination. Though she posted an early lead in the huge field of potential candidates, by December of 2019 her campaign had petered out, and she withdrew from the running, citing a lack of funds.

Emails obtained by Wikileaks show the sister of current Democrat vice presidential candidate Kamala Harris was invited to speak at a “pizza party” hosted by Tony Podesta.

A March 2016 email chain documents Maya Harris, former vice president of the Ford Foundation and Clinton policy advisor, was a guest of honor to the “Pizza for Hillary” RSVP event held April 10 at the home of millionaire Tony Podesta, Hillary Clinton campaign chair John Podesta’s brother.

“John — Hosting pizza party at Belmont for HFA on April 10. Maya Harris is joining, but need you. Can you come? Thanks much,” an email from Tony to his brother reads.

An official invitation shows Harris was a major attraction at the event, which was also attended by “Chef James Alefantis of Comet Ping Pong.”

“On April 10, join John Podesta, Campaign Chair, and Maya Harris, Senior Policy Advisor and special guest Chef James Alefantis of Comet Ping Pong for a evening of pizza and conversation at the home of Tony Podesta in Washington, D.C.,” the invitation reads.

The emails appear in a 2016 Wikileaks data dump of Podesta emails which were slow-drip leaked throughout October ahead of the 2016 election on November 8, however they are not found in docs highlighted by the organization Tuesday which dealt primarily with Kamala.

The emails also highlighted John Podesta was invited to attend a bizarre “spirit cooking” occult ritual dinner hosted by performance artist Marina Abramovic on July 9, 2015.

“Spirit cooking refers to ‘a sacrament in the religion of Thelema which was founded by Aleister Crowley’ and involves an occult performance during which menstrual blood, breast milk, urine and sperm are used to create a ‘painting,'” Paul Joseph Watson wrote at the time.

A rape survivor named Joey Piscitelli exposed Democrat vice presidential candidate Kamala Harris for allegedly turning a blind eye to rampant sexual abuse taking place in the California Catholic Church.

In 2008, a jury found Piscitelli was a victim of rape while attending the Salesian College Preparatory, a Catholic high school in Richmond, California.

In a 2019 interview with The Intercept, Piscitelli described the assaults he was subject to in high school and how Harris’ predecessor as California Attorney General, Terence Hallinan, was going after the priests and employees of the San Francisco Archdiocese.

The Intercept reported, “Hallinan’s team had prosecuted cases of abuse that had occurred decades earlier and had gathered evidence as part of a probe into widespread clergy sexual misconduct. Just six months before Harris took office, a U.S. Supreme Court decision overturned a California law that had retroactively eliminated the statute of limitations for criminal prosecution of child molestation cases.”

After Harris took over as AG, she refused to release the files Hallinan collected regarding child abuse among the clergy.

Joey Piscitelli sent a letter to Harris in 2010, after she decided to keep the files sealed, writing, “It is not understandable that you have refused to release the documents that have been previously collected by DA Terence Hallinan, that spell out the names of the child rapists, and molesters who have wreaked havoc on children here.”

“It was just a flat-out insult,” Piscitelli said of the matter. “She could have redacted the names, blacked out the names and left them out.”

“It went from Terence Hallinan going hundred miles an hour, full speed ahead, after the Catholic Church to Kamala Harris doing absolutely nothing and taking it backwards hundreds of miles an hour,” Piscitelli added.

As our society continues to literally come apart at the seams, one of the last things that we need is a power-hungry authoritarian in the White House.

Could the White House soon be occupied by a power-hungry authoritarian that will not hesitate to use the full power of the presidency to absolutely crush political enemies? And no, I am not talking about Joe Biden. There are certainly a whole lot of negative things that you can say about Joe Biden, but I wouldn’t call him an “authoritarian”. In part one of this series, I called him a “creepy old man that likes to sniff hair and rub up against people at awkward moments”, and at this point everyone can see that he is in an advanced state of decline. In fact, one recent survey found that 59 percent of likely voters do not believe that he will even finish a single term in the White House…

In another illustration of how many Americans are concerned about Joe Biden’s advancing age and declining mental faculties, a new Rasmussen poll has found that 59 percent of likely voters don’t believe he’ll finish a 4 year term in the White House.

Broken down along party lines, 74 percent of Republicans believe Biden won’t make it through his first term while 49 percent of Democrats agree.

Of course that survey question assumed that Biden will make it to election day, and there is absolutely no guarantee that will actually happen considering how rapidly he is deteriorating.

In any event, it appears that Kamala Harris will take over for Biden at some point, and that should deeply alarm all of us.

There are some people that get into politics because they truly want to serve the American people, and there are others that get into politics for the fame and the power. Tom Del Beccaro actually ran against Kamala Harris in California, and he assures us that she is squarely in the latter category…

For Harris, politics is a game of ambition not something of substance.

She is not a policy person. Her convictions aren’t with respect to the issues; they are with respect to power and the limelight.

And once she gets her hands on power, she is not afraid to abuse it.

During her time as attorney general of California, she ruthlessly went after pro-life activist David Daleiden. You may remember that Daleiden had filmed numerous undercover videos in which Planned Parenthood employees admitted that they make huge profits from the sale of tissue from aborted fetuses, and that upset Harris so greatly that she sent a team of heavily armed agents to his home to seize all of his footage…

Daleiden, the founder of the pro-life Center for Medical Progress and a self-described citizen journalist, made headlines last summer with a series of “sting” videos purporting to show Planned Parenthood clinic employees discussing the illegal sale of tissue from aborted fetuses.

The videos prompted a congressional investigation and an attempt by GOP lawmakers to defund Planned Parenthood. The women’s health provider also sued the Center for Medical Progress, claiming the videos were deceptively edited.

Throughout her tenure, Harris seemed to think that the solution to just about any problem was to throw someone in jail. In fact, at one point she even supported a bill which would have put “parents of truant children” in prison…

Harris was also fond of overcriminalization. She supported legislation that would jail the parents of truant children. She strongly opposed criminal justice reform measures throughout her tenure in California. She also supported the Golden State’s unconstitutional law muzzling crisis pregnancy centers, which the Supreme Court struck down last year as a clear violation of the First Amendment and an attempt to criminalize the moral and political viewpoints of others.

During the Democratic debates, Tulsi Gabbard used her record to attack Harris repeatedly.

In one very memorable moment, Gabbard pointed out that Harris put more than 1,500 people in prison for marijuana violations even though Harris basically admitted that she had used marijuana herself…

I want to bring the conversation back to the broken criminal justice system that is disproportionately negatively impacting black and brown people all across this country today. Now Senator Harris says she’s proud of her record as a prosecutor and that she’ll be a prosecutor president.

But I’m deeply concerned about this record. There are too many examples to cite but she put over 1,500 people in jail for marijuana violations and then laughed about it when she was asked if she ever smoked marijuana.

She blocked evidence — she blocked evidence that would have freed an innocent man from death row until the courts forced her to do so. She kept people in prison beyond their sentences to use them as cheap labor for the state of California.

I don’t know about you, but that certainly does not sound like someone that I want in the White House.

And when she was running for president, Harris actually mocked Biden when he suggested that her plan to impose nationwide gun control via executive order would not be constitutional…

Last year, Senator Kamala Harris may have become the first presidential candidate in history to laugh derisively at the idea that the Constitution limits what a president can do.

When former Vice President Joe Biden said that her plan for gun control by executive fiat didn’t pass constitutional muster, she scoffed and deployed one of her canned one-liners, “I would just say, ‘Hey, Joe, instead of saying no we can’t, let’s say yes we can!’”

As bad as Hillary Clinton was, she never proposed using an executive order to institute a nationwide gun grab.

If Harris really does become president, I anticipate that there will actually be discussion in some red states about the possibility of declaring independence from the federal government.

Yes, I do think that things could really get that bad.

As our society continues to literally come apart at the seams, one of the last things that we need is a power-hungry authoritarian in the White House.

I don’t understand why Joe Biden would make such a choice, and if he wins in November we are going to be stuck with her.

Having Kamala Harris just one heartbeat away from the presidency is truly a nightmare scenario, because Joe Biden’s health would be the only thing standing in the way of a reign of terror unlike anything America has ever seen before.

Senator Kamala Harris of California, the former prosecutor who is running for the Democratic presidential nomination, on Monday committed to a host of executive actions to implement gun control measures that have long failed to pass in Congress.

At a town hall hosted by CNN, Ms. Harris said that, if elected, she would sign an executive order mandating background checks for customers of any firearms dealer who sells more than five guns a year. The executive actions would also include more stringent regulation of gun manufacturers that could result in revoked licenses or prosecution, as well as an attempt to close the loophole that allows some domestic abusers to purchase guns if their victim is an unwedded partner.

“There are people in Washington, D.C., supposed leaders,” Ms. Harris said on CNN Monday evening, “who have failed to have the courage to reject a false choice which suggests you’re either in favor of the second amendment or you want to take everyone’s guns away.”

“We need reasonable gun safety laws in this country, starting with universal background checks and a renewal of the assault weapon ban,” she added, “but they have failed to have the courage to act.”

She said she would introduce the executive actions if Congress did not pass gun control legislation in the first 100 days of her presidency.

The announcement marks the second policy proposal of Ms. Harris’s presidential run; the first was a federal increase in teacher pay. The two policies dovetail with Ms. Harris’s political wager, which combines her historic status as one of the most viable black women to run for president with a patchwork of incrementally progressive proposals.

In the past year, gun control has re-emerged as a top priority for Democrats, particularly after the youth-led March for Our Lives brought thousands of motivated high schoolers to Washington last year. Even as the issue has gained traction in statehouses, however, Congress has failed to enact any major gun control legislation, and Ms. Harris’s executive action would be undoubtedly controversial and would quite likely face legal challenges.

After the shooting of elementary school students in Newtown, Conn., former President Barack Obama made gun control a top priority, exerting significant political capital in a failed attempt to pass universal background checks for gun purchasers.

As a California prosecutor, Ms. Harris supported such legislation, while also calling for bans on assault weapons and high-capacity magazines, prohibiting those convicted of a federal hate crime from purchasing guns, and making gun trafficking a federal crime.
 
The Epic Blandness of the Joe Biden Campaign

Back in early 2019, a group of about 15 campaign journalists took part in an informal survey of who they expected to be the Democratic presidential nominee.

These reporters and editors, I happen to know, are all smart and well-connected. Unfortunately, the survey results cannot be offered as an exhibit for the case. The person who received the most predictions as eventual nominee was Beto O’Rourke. (Yes, same here: This will refresh your memory.) The person who came in a close second was Kamala Harris. Joe Biden was predicted by zero respondents.

The survey is an artifact of the past that illuminates two important points about the present.

The obvious point is about the fallibility of prediction, and the frequency with which the political-media class fails to perceive powerful currents in the electorate. That’s worth remembering on the brink of virtual conventions, when a lot of coverage is describing the Biden-Harris ticket as in command of the race.

The less obvious point is the more consequential. For the moment, Biden looks to be transforming a political culture, with its corresponding customs, that has prevailed for six decades. It is an astonishing achievement for a candidate whose public career, at the start of the year, looked like it had just a few weeks left to live.

Reporters twenty months ago—or even six months ago, after Biden’s shockingly weak finishes in the first three states of the nominating contest—were viewing the former vice president through the prism of a familiar standard. Since JFK inaugurated the television era of politics in 1960, successful presidential candidates have been theatrical candidates. The exceptions, like Gerald Ford or George H.W. Bush, had short tenures that tended to prove the rule. Winning politicians have had narrative electricity—they were performers and story-tellers who could command the attention of people who loathed them no less than those who revered them.

Biden promises an end to that era. The narrative drama in his performances comes largely from the possibility that he will step on his own words and create a self-damaging storyline. After marinating for 36 years in the U.S. Senate, the best that can be said about his political persona is that it is bland. What is now clear is that his claim on the presidency comes not despite blandness but in essential ways because of it.

Biden is not just bland, but epically bland. Combined with his selection of Harris as running mate—so far a choice that looks both safe and impressive—Biden more than any candidate of the modern era is running not as galvanizing personality but as a composite Democrat. His life story is striking, marked by tragedy and heroic persistence, but his leadership persona is indistinct, elastic. In ordinary times that is an implausible trait for presidential challenger. In extraordinary times, against an incumbent like Donald Trump, it may be an indispensable trait. Trump did not invent the cult of presidential personality, but he is its most bizarre manifestation. A generic politician, wrapped in plain packaging, offers the starkest contrast in modern presidential history.

Biden’s task of deprogramming the cult of the presidency has been helped immeasurably by the coronavirus pandemic. My colleague Chris Suellentrop has a shrewd observation: The appeals of a couple generations of would-be political reformers effectively have been answered in 2020, at least as represented by the Democratic campaign.

Let’s end the permanent campaign, the reformers say, and have short European-style elections. Huddled at home since March, with only episodic appearances, Biden has been fine with that part. Let’s embrace a more parliamentary brand of politics, dispensing with the exaggerated emphasis on personalities, by making the election fundamentally about the platforms of competing parties. Biden, of necessity, is fine with that part, too.

Like more flexibility to work away from the office, this is one aspect of pandemic living that we may wish to keep even when the pandemic passes.

Trump, like several predecessors facing tough re-election, has had an answer to the polls that show anyone from the opposition party could beat him. He won’t run against “anyone.” All elections are against a specific someone, with ample opportunity to define and dismantle that person in a head-to-head contest. The signal question for Democrats heading into the fall is: How durable is Biden’s blandness?

Even if Biden’s cult of non-personality is a short-lived phenomenon, the moment of appreciation for the virtues of blandness is historically noteworthy. The author Garry Wills once wrote of “The Kennedy Imprisonment.” The alluring parts of the Kennedy dynasty—the fusion of idealism, glamour, and power—created a heroic mythology that depended heavily on illusion. The pressure of maintaining the illusion led inevitably to excess, scandal, tragedy. The imperative of projecting heroic personas arguably represented an imprisonment not just for the Kennedy family but for a generation of politicians who believed that in the modern age leadership is preeminently about style.

The power of this tradition surely is why the journalists in the informal survey seemed most captivated by O’Rourke. They seemed to fit within a charismatic tradition that started with the Kennedys and included Bill Clinton and Barack Obama.

Biden, an Irish-American who said he was inspired to pursue politics in part by the Kennedys, early in his career was a vivid illustration of a politician who seemed trapped by their example. He was crippled in his 1988 run for the presidency by a conviction that he could not run as a plain-spoken average Joe from Delaware. He had to sound inspiring and lyrical. So he cribbed from speeches by British politician Neil Kinnock and got mocked for plagiarism.

Now, days away from formal nomination and 81 days until voters will decide if he gets the prize he has been hungering for during 48 years on the national stage, Biden seems liberated from outsize expectations of charisma.

Both he and Harris, in their remarks Wednesday in Delaware, emphasized themes of competence, responsibility, and civic rehabilitation more than pulse-quickening inspiration. “Work” was the recurring theme. “You ready to go to work?” Biden asked. “I’ve never been more ready to roll up my sleeves and get to work,” Harris answered in her own remarks.

A Democratic strategist Tuesday, upon news of Harris’s selection as running mate, noted the safeness of the pick, in a campaign that is all about practicality—“Like buying a minivan.”

A minivan doesn’t turn heads, but is a reliable way to get Democrats to their destination.

Regular readers of CHQ will recall the 2016 controversy over whether Senator Ted Cruz was a “natural born citizen” of the United States and thus eligible to be President or whether he was citizen not natural born, and thus, according to the Constitution’s Article 2, Section 1, not eligible to hold the office.

At the time we argued that Sen. Cruz was eligible and the notion that there were three types of citizenship – natural born, citizen not natural born and naturalized citizen – was not supported by either history or legal precedent.

However, since the Cruz controversy there has been a great deal of new scholarship and commentary regarding whether Democratic Senator Kamala Harris likewise meets the test that has caused us to reopen the discussion and invite CHQ readers to weigh-in.

While there are many good articles on the subject we found this one by Thomas Sayre to be among the most cogent and well-documented.

According to Mr. Sayre, the U.S. Constitution says that "no person except a natural born citizen, or a citizen of the United States, at the time of the adoption of this Constitution, shall be eligible to the office of President." The Constitution was later amended to extend this requirement to the Vice President.

All persons who were citizens at the time of the adoption of the Constitution are long dead. Only the "natural born citizen" qualification remains in practical effect.

The key question is whether Kamala Harris is a "natural born citizen" of the United States. According to the clearly written definition, which has been acknowledged for over two centuries, argues Mr. Sayre, if one of her parents was not a US Citizen at the time of her birth, she is not a natural born citizen.

When one examines the definition of the term and the purpose for including it in the Constitution, this becomes clear says Mr. Sayre.

The Definition:

"The first and governing maxim in the interpretation of a statute is to discover the meaning of those who made it." --James Wilson, Of the Study of Law in the United States, 1790

What is the source of the term, "natural born citizen"? It is defined in the internationally published reference book, "Law of Nations", penned by Emmerich de Vattel in 1758. The definition states:

"The natives, or natural-born citizens, are those born in the country, of parents who are citizens." - Law of Nations

This is the one and only definition of the term, understood in international and US law, that existed when the Constitution was crafted. Its meaning has remained consistent for centuries as recognized by US law.

"This 1758 work by Swiss legal philosopher Emmerich de Vattel is of special importance to scholars of constitutional history and law, for it was read by many of the Founders of the United States of America, and informed their understanding of the principles of law which became established in the Constitution of 1787." - Constitution Society regarding "Law of Nations"

Did The Framers Rely Upon Law of Nations?

The historical record shows that "Law of Nations" was a primary reference used to craft the US Declaration of Independence and the US Constitution. In 1755, as the Founders determined to create their own nation from scratch, Benjamin Franklin received three copies of the original French edition from the editor Dumas for use by the Continental Congress.

"I am much obliged by the kind present you have made us of your edition of Vattel. It came to us in good season, when the circumstances of a rising state make it necessary frequently to consult the Law of Nations. Accordingly, that copy which I kept has been continually in the hands of the members of our congress..." - Benjamin Franklin’s letter to Charles W.F. Dumas, December 1775

"Law of Nations" was in use by many other nations as well, printed in several languages including French, English and German, to ensure heads of state understood principles and language to be used in international relations. It is still in print today as a reference book and is still used by the Supreme Court in Constitutional rulings.

By 1780, "Law of Nations" was a standard textbook in American universities. By 1787, it was well understood by the Framers of the Constitution and the nation as a whole. There was no need to debate the meaning of "natural born citizen" as the Framers crafted the Constitution. It was a commonly understood term.

Law of Nations is the only reference book named in the Constitution itself, empowering the Federal Government to enforce its clauses:

To define and punish Piracies and Felonies committed on the high Seas, and Offenses against the Law of Nations; - US Constitution, Article 1, Section 8

Kamala Harris was born October 20, 1964, in Oakland, California. Her mother was a Tamil Indian, her father a Jamaican. Both were immigrants who had not naturalized, thus were not citizens, when Kamala was born.

As the definition of "natural born citizen" states, the person must be born to parents who are citizens.

This fact alone is enough to conclude, without question, that Harris is not eligible to be President of the United States.

You could stop reading at this point. You have the correct answer noted Mr. Sayre.

If that is the case, then the law will be upheld, Harris will be barred from taking office, everything works out. Right?

Perhaps not. You may have noticed, wrote Mr. Sayre, there is a great effort afoot to concoct alternate meanings of the term and confuse the issue to allow candidates such as Harris to take office. This strategy worked for Barack Hussein Obama, so it will be used again.

That's right, Mr. Obama also could not qualify and he knew it. His father was not a US Citizen when he was born. So, his teams of lawyers spent years blocking court cases that tried to resolve his eligibility long after he was allowed to take office. The fight began when a Democrat attorney, Philip Berg, attempted to force his own Party to vet their candidate's eligibility. See the problem?

Why A Natural Born Citizen?

So, what does it matter, this difference between merely being born a citizen or meeting the much more strict requirements of a "natural born citizen"? The person is an American either way, right? The Framers of the Constitution understood the difference and so should we.

A person born an American, with a foreign parent, is born subject to the laws of another nation. Born in America to Mexican parents? The child is born under Mexican as well as American jurisdiction. The child is born with foreign allegiance. That can create legal and personal conflict in times of war.

The Framers understood that a person born in the USA to a British father would be a British subject, according to British law. If that person rose to the rank of Commander in Chief of the American military and went to war against England or its vassal states, that person would commit treason against his King. His motives may be conflicted and he would certainly be treated differently from regular prisoners of war if captured. He would be hanged for treason.

In the War of 1812, when America fought to finally throw off British common law claims over Americans, the US required all officers on US ships and 2/3 of the sailors to be natural born citizens of the USA. They could not have a foreign parent. Thus, they could engage in war without conflicting loyalties or threat of hanging for treason.

In peacetime, the President with foreign affinity may use his office to conduct affairs more favorably to his preferred foreign state instead of the USA. He may hold notions such as "Dreams from my Father", a love and loyalty to the Father's nation and ideology.

Is the President loyal to the Russians because of a Russian father? Perhaps loyal to Marxist or Islamic ideology because of the ideological loyalties of a Father who had not embraced Americanism and passed it down? The office of President allows a lot of leeway to favor those non-American loyalties and further their interests at the expense of America.

The President with mixed loyalties has great power to do harm. So, yes, this natural born citizen requirement is as important today as it was when written into the Constitution concluded Mr. Sayre.

Mr. Sayre’s commentary about divided loyalties is particularly applicable to Senator Harris, who spent much of her youth in Canada, where her mother was a professor.

From our perspective, the circumstances of Kamala Harris’s birth amount to birth tourism where the child is born in the geographic confines of the United States for the sole purpose of obtaining American citizenship and then whisked off to another country, only to return when and if being an American is economically advantageous.

Applying the logic, and the historical and legal arguments outlined in Mr. Sayre’s article to Sen. Kamala Harris leads us to conclude she is not a “natural born” citizen, rather, she is more like America’s most high profile and least grateful anchor baby.

Update. Kamala Harris has a half black father who claims to be a descendant of a Jamaican slave owner. Her mother is a Tamil speaking Dravidian Hindu whose skin is as dark as her daughter. Some upper caste Hindus in northern India have very light skin.
Her mother is a Dravidian from the South. Kamala Harris has a Jewish husband and no children. To say she is black is stretching the point. (17)

Update 2: Government Accountability Institute President Peter Schweizer said (On Tucker Carlson show) ““Tucker, from 2004 to 2011, she was San Francisco attorney general,” he continued. “She did not prosecute a single case of sexual abuse involving Catholic Church priests. To put that in context, of the 50 largest cities in America, all 50 of them prosecuted at least one case during that time period, except for Kamala Harris. And in addition to that, she inherited, from her predecessor, Terence Hallinan, hundreds of pages of internal Catholic documents that included the names of 40 current or recent priests who had been charged by parishioners with molestation.”

“Hallinan was using those documents to build criminal cases, and he was also planning to release them after redacting the names of victims,” Schweizer added. “Kamala Harris actually deep-sixed that document and froze those documents, and those documents disappeared, much to the chagrin of victims’ groups. So, it’s a massive cover-up. And a lot of the people that financed her campaign to beat Hallinan were law firms and lawyers and people connected to the church hierarchy, who did not want that — those documents to come out.” (18)

Biden selecting Kamala then remembering Kamala believed his accusers.

Ordered to reduce the population of California’s overcrowded prisons, lawyers from then-California Attorney General Kamala Harris’ office made the case that some non-violent offenders needed to stay incarcerated or else the prison system would lose a source of cheap labor. In 2011, the Supreme Court ruled in Brown v. Plata that California’s prisons were so overcrowded that they violated the Constitution’s prohibition of cruel and unusual punishment. Three years later, in early 2014, the state was ordered to allow non-violent, second time offenders who have served half of their sentence to be eligible for parole. (3)

Kamala Harris refused to endorse sentencing reform measures on the ballot in 2012 and 2014. When a federal judge ruled in 2014 that California’s application of the death penalty was unconstitutional, Harris fought that ruling too. (4)

Harris also wanted to threaten the parents of truants with jail time. (5)

Harris challenged the release of a man who had been exonerated by the Innocence Project and had his conviction overturned. Harris argued that Daniel Larsen, who spent 13 years in prison for the crime of possessing a concealed knife, had not produced evidence of his innocence fast enough. A federal judge overturned his conviction after finding that Larsen had shown he was innocent, that the cops testifying at his trial weren’t credible, and that his attorney, since disbarred, was constitutionally ineffective because he had failed to call any witnesses. Kamala Harris posted Father’s Day greetings to Twitter on Sunday comparing deployed military fathers who are away from their children on Father’s Day to illegal aliens and accused criminals. Harris listed them in presumed order of dearness to her heart, putting US military dads third behind first-in-her heart illegal aliens and accused criminals who can’t make bail. “Today I’m thinking of the fathers who can’t be with their children because they were ripped from their sons and daughters at the border. The fathers who can’t celebrate today because they can’t afford bail. The fathers who are deployed. … (7)

Kamala Harris insists that government should dictate how much red meat you are allowed to consume. According to Harris, Americans need to be eating far less meat in order to prevent carbon dioxide (CO2) emissions from warming the planet. (8)

Kamala Harris Proposes A 10-Hour School Day. According to The Hill, Harris’ Family Friendly Schools Act would create a “pilot program to give schools funds to stay open during the entire workday throughout the school year, as well as to invest over $1 billion to boost summer learning programs.” (9)

Kamala Harris proposed a bill to subsidize the rents of legal and illegal aliens by taxing residents of poorer states like Iowa and Ohio to help landlords in California and New York charge more rent. (10)

Kamala Harris Supports Canceling Columbus Day (11)

Harris claimed last night to have been one of the earliest and biggest proponents of police-worn body cameras. But as recently as 2015, she was arguing against making it California’s official statewide policy. “I as a general matter believe that we should invest in the ability of law enforcement leaders in specific regions and with their departments to use … discretion to figure out what technology they are going to adopt based on needs that they have and resources that they have,” Harris said at the time. Harris told viewers that she disagreed with President Obama’s policy of informing Immigration and Customs Enforcement (ICE) when undocumented immigrants were arrested for state or local crimes. But “as district attorney of San Francisco, Kamala Harris supported a city policy that required law enforcement to turn over undocumented juvenile immigrants to federal immigration authorities if they were arrested and suspected of committing a felony, regardless of whether they were actually convicted of a crime,” (13)

Kamala Harris Has To Answer For Not Prosecuting Steve Mnuchin; Steve Mnuchin and OneWest Bank were, according to a memo obtained and reported on by The Intercept, guilty of “widespread misconduct” in the form of over 1,000 legal violations. The memo was the result of a year-long investigation and it asserts that OneWest Bank operated to intentionally boost foreclosures. The Campaign for Accountability called for a federal investigation of Mnuchin and OneWest Bank claiming they used “potentially illegal tactics to foreclose on as many as 80,000 California homes.” Yet despite internal memos explicitly mentioning numerous prosecutable offenses by Mnuchin and co., then California Attorney General Kamala Harris refused to prosecute. She’s never given an explanation for her decision and Mnuchin later donated $2,000.00 to Harris’ campaign. It was his only donation to a Democratic candidate. (14)

This is an update. I found a video of Tucker Carlson’s interview regarding Kamala Harris covering up 40 cases of child sexual abuse in exchange for campaign cash.

Tulsi scored some points in this debate. Kamala had no specific answers. Harris scored only 3% on the Drudge poll. Gabbard scored 42%.

Kamala Harris lied in that famous debate confrontation with Joe Biden. That public school was desegregated before she was born. And her Indian born mother took her to Canada when she was 7. If Joe Biden had a brain and were 30 years younger, he could have said, “Excuse, but you were in Canada at that time.”

LAPD never bothered to check the defendant’s phone records in the 30 days prior to his arrest. The records would have proved that he never made the 2 phone calls in question. Kamala Harris wanted to prosecute him for a hate crime. The man who made the calls was the son of a prominent Democrat judge and was never charged.

Democratic presidential nominee Joe Biden announced Tuesday that former primary rival and California Sen. Kamala Harris had been chosen as his 2020 running mate, officially proving the former vice president has no business making executive decisions on behalf of the United States.

The selection of Harris, however, was far from the worst of things, as Biden somehow made a public relations nightmare out of a moment that traditionally has been known to reinvigorate stagnant campaigns stepping into the general election season.

Posting to Instagram a photograph of himself virtually extending the vice presidential offer to Harris, Biden drew harsh criticism from sharp-eyed social media users such as Turning Point USA Chief Creative Officer Benny Johnson, who was quick to point out that the moment captured was anything but presidential.

In fact, in true Biden fashion, there was an embarrassingly obvious mistake — and where there was one, there were many:

1. On Script.

Before moving into the weeds on every detail of this “Where’s Waldo” of stupidity, most people who saw the image were quick to highlight the most egregious element of the photograph: What seemed to be a typed script laid out in front of Biden for the conversation.

And from The Federalist to the BizPac Review, conservative media outlets were quick to blow up the image Biden provided, widely publicizing any embarrassing rhetorical tidbit they could expose.

Included in the script were several simple reminders, such as the words “I’m calling you today because,” which seemingly were left to ensure that Biden did not forget the purpose of the conversation, along with prepared talking points detailing the reasons Harris had been selected.

“I think you’re entitled to know why I chose you, there are three reasons,” the script read in one location.

Apparently, the candidate could not be bothered to remember those reasons for himself — a likely consequence of Harris being chosen in large part at the discretion of aides far more lucid than Biden.

2. Out of Touch.

Another point of focus for keen eyes across the social media sphere was the way Biden was holding his cellphone while extending the offer to Harris.

It was upside down in the former vice president’s hands, with the speaker pointed away from him and toward the computer screen where live video appeared of Harris on the other end of the line.

Now, to be fair, perhaps Biden isn’t so technologically inept that he doesn’t know where the speaker and microphone appear on an iPhone. Perhaps campaign staffers placed Biden on a video call with Harris via computer, and a third party was being added to the call via cellphone.

But this would hardly come as an excuse.

The year is 2020. We have the technology to conduct small-group and large-scale conference calls.

If Biden’s closest aides were unaware of this — or simply did not care about the optics of jerry-rigging a phone to a computer for a three-way conference call — that does not bode well for America.

Not only would we have a potentially senile man one step away from the presidency, but a senile man with inept and uncaring handlers one step away from the presidency.

3. Plagued with Existential Dread?

If this, plus Biden’s laundry list of other embarrassing moments from a year on the trail, weren’t enough to convince you the man is mentally unfit for the presidency, only one thing could: a subliminal cry for help buried in the vice presidential announcement images.

Of course, you know that I’m referring to the framed comic strip front-and-center on Biden’s desk.

The strange desk ornament, elevated and perfectly lit behind Biden’s computer, seems to be a series of frames from Dik Browne’s popular gag-a-day newspaper cartoon “Hägar the Horrible.”

Hard to make out in the images provided, but no less visible, the particular strip that was present depicts the titular cartoon viking shouting to the heavens in a show of frustration at the horrible weather around him.

“WHY ME?!” Hägar’s speech bubble reads.

Yeesh, if that isn’t clear evidence of existential dread rising within the longtime Democratic politician as the campaign season drags on, I don’t know what is.

OK. So maybe that’s an overstatement.

But you have to acknowledge, for a man so clearly steeped in mental disarray, the cartoon is a bad look — just like pretty much everything else Biden does in public.

In an opinion article published by Newsweek on Wednesday titled, “Some Questions for Kamala Harris About Eligibility,” law professor John C. Eastman questioned Kamala Harris’ eligibility vice president of The United States.

The article focused on the common debate among Constitutional scholars regarding the 12th Amendment.

According to the 12th Amendment, “no person constitutionally ineligible to the office of President shall be eligible to that of Vice-President of the United States.”

Article II of the Constitution specifies that “[n]o person except a natural born citizen…shall be eligible to the office of President.”

This being said, Eastman noted that neither of Harris’ parents were naturalized U.S. citizens at the time of Kamala’s birth in 1964.

Her father is from Jamaica, where the family business was owning slaves, and her mother is from India.

Because of her parents’ status, Kamala is not technically a “natural-born” citizen and is therefore not eligible to serve as vice president.

Eastman explained how some scholars argue the 14th Amendment classifies a “natural-born” citizen as anyone who was born in America.

However, he claimed these allegations are erroneous, explaining, “The language of Article II is that one must be a natural-born citizen. The original Constitution did not define citizenship, but the 14th Amendment does—and it provides that ‘all persons born…in the United States, and subject to the jurisdiction thereof, are citizens.’ Those who claim that birth alone is sufficient overlook the second phrase.”

“The person must also be ‘subject to the jurisdiction’ of the United States, and that meant subject to the complete jurisdiction, not merely a partial jurisdiction such as that which applies to anyone temporarily sojourning in the United States (whether lawfully or unlawfully),” Eastman continued.

After making his case, Eastman maintained, “Indeed, the Supreme Court has never held that anyone born on U.S. soil, no matter the circumstances of the parents, is automatically a U.S. citizen.”

In fact, when examining the original meaning of the 14th Amendment, the legal expert found Harris may not qualify for her current position as a U.S. senator.

Foreseeing a backlash to the claims made in the article, Eastman wrote, “I have no doubt that this significant challenge to Harris’ constitutional eligibility to the second-highest office in the land will be dismissed out of hand as so much antiquated constitutional tripe.”

“But the concerns about divided allegiance that led our nation’s Founders to include the ‘natural-born citizen’ requirement for the office of president and commander-in-chief remain important; indeed, with persistent threats from Russia, China and others to our sovereignty and electoral process, those concerns are perhaps even more important today,” he concluded.

Following cries of “racism” from Newsweek‘s leftist readers, the magazine issued an editor’s note stating, “Some readers reacted strongly to this essay, seeing it as an attempt to ignite a racist conspiracy theory. That is entirely inaccurate.”

Newsweek editors wrote a whole article defending the Eastman opinion piece and explaining to their reactionary followers that the op-ed was not written to create a race-based movement against Harris.

“Editor’s Note: Eastman’s Newsweek Column Has Nothing to Do With Racist Birtherism,” the response post was titled.

Instead, the editors explain, Eastman’s article “Was focusing on a long-standing, somewhat arcane legal debate about the precise meaning of the phrase ‘subject to the jurisdiction thereof’ in the Citizenship Clause of the 14th Amendment.”

The outlet made sure to distance the Eastman piece from the “birther” theories that looked into the birthplace and suspicious birth certificate of Barack Obama in 2008.

“We share our readers’ revulsion at those vile lies,” Newsweek ensured their base.

Will Eastman’s Constitutional concerns be debated on a national stage or will mainstream media dismiss such a conversation as a racist distraction?

WASHINGTON (JTA) — Kamala Harris, the junior senator from California, is reportedly set to announce her bid for the Democratic presidential nod.

Harris, 54, is a progressive on most issues who draws some ire from the left for her tough-on-crime posture when she was California’s attorney general. She pleased Democratic hearts, meanwhile, with her tough treatment of President Donald Trump’s second Supreme Court nominee, Brett Kavanaugh, during his Senate confirmation last year.

The daughter of a mother who immigrated from India and a father who immigrated from Jamaica, Harris has some Jewish nuggets in her history.

She smashed a glass at her wedding

She met her Jewish husband, Douglas Emhoff, on a blind date in San Francisco, arranged by friends. They married in 2014 — Harris’ sister Maya officiated — and smashed a glass to honor Emhoff’s upbringing. It was her first marriage and his second — Emhoff has two children from his first marriage.

You thought Jews can be parochial? “Most eligible Indian American bachelorette marries fellow lawyer” is how one Indian American media outlet reported the story.

Emhoff took the Washington, D.C. bar exam in 2017 so he could work in the same city.

Emhoff’s Twitter feed is pretty much “I love my wife” all the time (take that, Kellyanne and George Conway).

She did the blue box thing

“So having grown up in the Bay Area, I fondly remember those Jewish national fund boxes that we would use to collect donations to plant trees for Israel,” she said at the American Israel Public Affairs Committee in 2017. “Years later when I visited Israel for the first time, I saw the fruits of that effort and the Israeli ingenuity that has truly made a desert bloom.”

No mention why Harris was a blue box girl growing up — and Google was no help. JTA has put a query into her office.

She’s more AIPAC than J Street

Since being elected in 2016, Harris has spoken twice at the annual policy conference of the American Israel Public Affairs Committee. Her 2018 speech, with the California delegation, was off the record (itself not unusual, although critics of Israel were unnerved), but she gave a good picture of where she stands in her 2017 speech.

She’s for two states — so is AIPAC, although, sometimes less than emphatically — but she doesn’t believe in big-footing either side.

“I believe that a resolution to this conflict cannot be imposed,” she said. “It must be agreed upon by the parties themselves.”

More than half of the Democratic caucus in the Senate gets the endorsement of J Street, the Jewish liberal lobbying group that believes pressure is necessary to start peace talks. J Street did not endorse Harris. Her only association with the group was in November 2017, when she was one of 17 local and federal politicians on the host committee (i.e., “yes you can stick my name on the invitation”) of a party thrown by J Street’s Los Angeles chapter. She also met a year ago in her office with the group’s director, Jeremy Ben-Ami.

Harris also co-sponsored a Senate resolution in early 2017 that essentially rebuked the Obama administration for allowing through a U.S. Security Council resolution condemning Israel’s settlement policies.

She supported the Iran nuclear deal, although she was not a senator in 2015 when Congress voted on it, and is on the record opposing the Boycott, Divestment and Sanctions movement targeting Israel.

Harris also digs Israel’s Supreme Court building.

“The beauty of the architecture and spirit of design left a lasting impression — the straight lines in the building represent the immutable nature of truth, while the curved glass and walls were built to represent the fluid nature of finding justice,” she told the J. The Jewish News of Northern California in 2016. “The Court, like Israel, is a beautiful home to democracy and justice in a region where radicalism and authoritarianism all too often shape government.”

She’s big on tackling hate crimes

Harris created a hate crimes unit as San Francisco District Attorney and made hate crimes a focus of her work as the state’s attorney general. (Harris reported that in 2012 anti-Jewish hate crimes were the most commonplace religion-based hate crime.)

One of her first successful Senate actions was to get passed a non-binding Senate resolution that named religious institutions as possible targets of hate crimes, and urged better hate crime reporting, a key demand of Jewish civil rights groups over the years.

Her big sisters are Jewish

Well, in political terms, anyway. In October 2016, she got key endorsements from the state’s two Jewish senators — Barbara Boxer, who was retiring and whom Harris would replace, and Dianne Feinstein, the state’s senior senator. This was important because in California’s “jungle primary” system the two top vote-getters in the primaries get on the November ballot even if they are of the same party. Harris was facing a popular Democrat, Rep. Loretta Sanchez, in the general election.

Joe Biden's campaign announced Thursday that it brought in $34.2 million in donor dollars since unveiling Sen. Kamala Harris as the vice presidential pick.

Biden's digital director Rob Flaherty announced the sum via Twitter, saying the amount was raised between August 11 and 12, the date Harris' name was first revealed and when she made her first appearance on the campaign trail alongside the presumptive Democratic nominee.

Flaherty also revealed that $1.3 million was spent on yard signs emblazoned with the new Biden-Harris logo.

On Wednesday night, at the first fundraiser where Biden and Harris appeared together, the former vice president revealed the tally was up to $26 million, with the campaign garnering 150,000 new donors.

'It's really palpable, the excitement,' Biden said on the Zoom call.

Biden outraised President Donald Trump in May and June, but Trump bested the Democrat in July.

Biden and the Democrats, however, were in a competitive place at the end of July due to more frugal spending than Trump and the GOP.

CNN reported that Biden and the Democratic National Committee ended July with $294 million on hand, compared to the more than $300 million that Trump and the Republican National Committee reported having on hand at the end of last month.

A little after 4 p.m. Tuesday the Biden campaign announced Harris as his running mate via a text message to the former vice president's supporters.

About 24 hours later, Harris and Biden appeared together in Wilmington, Delaware to make the partnership official.

Biden had promised in March that he would select a female running mate to add balance and diversity to the Democratic ticket.

After the Memorial Day death of George Floyd that inspired global Black Lives Matter protests, there was additional pressure on the presumptive Democratic nominee to pick a woman of color.

In the days leading up to the announcement of Harris, Biden was suspected to have narrowed the field down to Harris, California Rep. Karen Bass and former U.N. Amb. Susan Rice.

Of the three, Harris was the most well known to the American people having run for the 2020 Democratic nomination herself, dropping out of the presidential race in December.

She made waves during the first Democratic debate by going after Biden - the heir apparent to the nomination - for talking up his work with pro-segregation Democrats and his stance on desegregation busing.

On Wednesday, Biden indicated anything that happened during the primary was water under the bridge.

He welcomed Harris and her husband Douglas Emhoff to the campaign as 'honorary Bidens' and spoke endearingly about his new running mate's friendship with his late son Beau.

In their announcement video he had a very simple script beneath the phone he was using to deliver the message. If you can’t list 3-5 things off the top of your head, you shouldn’t be trying to lead 300 million people
