Pelosi Congress Claims Sovereign Immunity in Federal Court to Keep Secret January 6 Videos and Emails​

(Washington, DC) – Judicial Watch announced that it filed an opposition to the U.S. Capitol Police’s (USCP) effort to shut down Judicial Watch’s federal lawsuit for January 6 videos and emails. Through its police department, Congress argues that the videos and emails are not public records, there is no public interest in their release, and that “sovereign immunity” prevents citizens from suing for their release.

Judicial Watch filed a lawsuit under the common law right of access after the Capitol Police refused to provide any records in response to a January 21, 2021, request (Judicial Watch v. United States Capitol Police (No. 1:21-cv-00401)). Judicial Watch asks for:
  • Email communications between the U.S. Capitol Police Executive Team and the Capitol Police Board concerning the security of the Capitol on January 6, 2021. The timeframe of this request is from January 1, 2021 through January 10, 2021.
  • Email communications of the Capitol Police Board with the Federal Bureau of Investigation, the U.S. Department of Justice, and the U.S. Department of Homeland Security concerning the security of the Capitol on January 6, 2021. The timeframe of this request is from January 1, 2021through January 10, 2021.
  • All video footage from within the Capitol between 12 pm and 9 pm on January 6, 2021
Congress exempts itself from the Freedom of Information Act. Judicial Watch, therefore, brought its lawsuit under the common law right of access to public records. In opposing the broad assertion of secrecy, Judicial Watch details Supreme Court and other precedent that upholds the public’s right to know what “their government is up to:”

“In ‘the courts of this country’— including the federal courts—the common law bestows upon the public a right of access to public records and documents” … “the Supreme Court was unequivocal in stating that there is a federal common law right of access ‘to inspect and copy public records and documents.’” … “[T]he general rule is that all three branches of government, legislative, executive, and judicial, are subject to the common law right.” The right of access is “a precious common law right . . . that predates the Constitution itself.”

The Court of Appeals for this circuit has recognized that “openness in government has always been thought crucial to ensuring that the people remain in control of their government….” “Neither our elected nor our appointed representatives may abridge the free flow of information simply to protect their own activities from public scrutiny. An official policy of secrecy must be supported by some legitimate justification that serves the interest of the public office.”

“The Pelosi Congress (and its police department) is telling a federal court it is immune from all transparency under law and is trying to hide every second of its January 6 videos and countless emails,” stated Judicial Watch President Tom Fitton. “The hypocrisy is rich, as this is the same Congress that is trying to jail witnesses who, citing privileges, object to providing documents to the Pelosi rump January 6 committee.”

In November 2021, Judicial Watch revealed multiple audio, visual and photo records from the DC Metropolitan Police Department about the shooting death of Ashli Babbitt on January 6, 2021, in the U.S. Capitol Building. The records include a cell phone video of the shooting and an audio of a brief police interview of the shooter, Lt. Michael Byrd. In October, Judicial Watch released records, showing that multiple officers claimed they didn’t see a weapon in Babbitt’s hand before Byrd shot her, and that Byrd was visibly distraught afterward. One officer attested that he didn’t hear any verbal commands before Byrd shot Babbitt.

Also in November, Judicial Watch filed a response in opposition to the Department of Justice’s effort to block Judicial Watch’s Freedom of Information Act (FOIA) lawsuit asking for records of communication between the Federal Bureau of Investigation (FBI) and several financial institutions about the reported transfer of financial transaction records of people in DC, Maryland and Virginia on January 5 and January 6, 2021. Judicial Watch argues that Justice Department should not be allowed to shield “improper activity.”

Former House Speaker Nancy Pelosi (D-CA) on Sunday suggested the states can overrule the US Constitution and ban Trump from the presidential ballot.

Pelosi appeared on ABC’s “This Week” to discuss Trump’s Colorado ballot appeal to the US Supreme Court with host George Stephanopoulos.
Last week President Trump asked the US Supreme Court to overturn the Colorado Supreme Court’s decision to bar him from the 2024 ballot.
The Colorado Supreme Court last month disqualified Trump from the 2024 ballot.
On Friday the US Supreme Court agreed to hear oral arguments in the Colorado ballot case.
The legal theories are based on Section 3 of the US Constitution’s 14th Amendment which states public officials who have “engaged in insurrection or rebellion against” the US may be disqualified from public office.
Trump has not been charged with engaging in insurrection or rebellion against the United States.
The US Constitution has three requirements to be president:
  • Be a natural-born citizen of the United States.
  • Be at least 35 years old.
  • Have been a resident of the United States for 14 years.
Nancy Pelosi however on Sunday said the states can overrule the US Constitution and ban Trump from the ballot.
Even George Stephanopoulos, a lifelong Democrat hack and Deep State asset was stunned by Pelosi’s suggestion.
“You believe [Trump] is ineligible to be president?” Stephanopoulos asked Pelosi referring to the 14th Amendment.
“They have different laws from state-to-state,” Pelosi said.
A stunned Stephanopoulos interrupted Pelosi and said, “It’s the Constitution…”
“That’s not the point,” Pelosi said as she explained that every state has different laws.

The following commentary was adapted from remarks I delivered at an event held in Toms River, New Jersey, by the Patriot Freedom Project, an organization, founded by Cynthia Hughes, committed to shedding light on the plight of January 6 defendants and their families.
Today we commemorate the third anniversary of one of the darkest days in our country’s recent history—though not for the reasons the Left believes.
The tragedy of January 6, 2021, was not that it was an “attack on our democracy,” let alone an “insurrection.”
But rather, it was an opportunity for the deep state to finally remove its mask and begin the persecution and imprisonment of American citizens, innocent patriots labeled domestic terrorists merely for exercising their First Amendment right to peaceably assemble on public property, the vast majority of whom did not commit any acts of violence on Capitol grounds. As we later found out, through the disclosures of footage from Capitol grounds that day, many of these peaceful demonstrators only entered the Capitol after being waved on by Capitol police, who actively enabled them to make the alleged breach, only to later turn around and scapegoat them as trespassers and insurrectionists when it became politically convenient to do so.

As we have also found out in the months and years since that fateful day, federal agents were seeded throughout the crowds, both outside and within the Capitol, tasked with openly inciting the demonstrators to violence. Despite that irrefutable fact, an exceptionally small number of them did commit any violence. Absolutely zero engaged in the act of insurrection, which is a legal term of art with a very specific meaning: namely, the Framers of the 14th Amendment, from where that term originates, had in mind preventing Confederate War Generals from returning to government, who took up arms and literally waged war against the Union. Nobody who showed up on the Capitol steps on January 6 engaged in a rebellion—hardly any of them were even armed, and those who were armed were, at most, carrying around pepper spray. Show me an example in the entire history of the world of a successful armed insurrection done with pepper spray.

The tragedy of January 6 continues through the present moment, on the third anniversary, and will remain a tragedy so long as innocent Americans remain locked up, every single one of them denied due process of law. This will likely continue until Donald Trump is reelected this November. As you all know, many January 6 prisoners continue to languish behind bars—many still in the DC Gulag, and some in the most horrific conditions of solitary confinement. The media has constantly demonized these political prisoners (which President Trump refers to as “hostages” of our government) as domestic terrorists. And the treatment they are currently getting is, unsurprisingly, that of a domestic terrorist: cruel and inhumane, deprived of fundamental rights, including the right to meaningful legal assistance, food in some cases, and the bare minimum necessities to stay alive. All for merely showing up on the Capitol, a public forum on which Americans have long enjoyed their rights to assemble and speak for centuries, to contest an election whose results were tainted by the stain of illegitimacy—something that history has vindicated, overwhelmingly, in the months and years since that day.

If the truth shall prevail, here is how history will remember January 6: peaceful demonstrators were finally fed up with a government that had become outwardly tyrannical (and I’m not talking about President Trump).
They saw violence all throughout the previous summer, committed by rogue, militant left-wing organizations such as BLM and ANTIFA. These organizations were allowed to commit untold billions of dollars of damage to public and private property, but the entire regime, including both party establishments and the mainstream media, excused them for every action and even designated them as “peaceful protests,” asking television audiences to deny observable reality, as churches were broadcast literally burning to the ground while businesses were looted and ransacked, and anarchy was unleashed in virtually every major city from coast to coast. This again was the backdrop against which, on January 6, a comparatively tame counter-response took place.

The 2020 presidential election observed all sorts of unprecedented rule changes, late-night ballot drop-offs, conveniently timed “water main” breakages that obstructed the electioneering process, not to mention rampant, government-instigated, top-down censorship of both stories like the Hunter Biden laptop scandal that would have been outcome-determining on the results of the general election, and political candidates, like the President of the United States himself, who was forced off every major social media platform—Facebook, Twitter, Instagram, you name it—thereby censoring his voice in the weeks before he left office.

So, the regime took away the President’s First Amendment right to speak and the people’s First Amendment right to peacefully demonstrate. The people who arrived at the Capitol on January 6 did so not out of retribution towards their government but out of desperation for their political situation—what felt like a last-ditch effort to have their voices heard.

The cause of January 6 is therefore ultimately the cause of the American republic: will it survive or will it too be relegated to the dustbin of history? That cause will be determined, ultimately, by whether President Trump is re-elected this November. So far, we have reason to be cautiously optimistic. He has never polled this well before in his entire political career. The momentum behind him seems to be growing stronger by the day, even as the weaponized justice system gets more and more belligerent, a sign of desperation for sure, with each successive indictment.

We are living through truly historic times, not just for the history of America but for the history of the world, because the 2024 presidential election will have world-historic consequences, for where America goes, so goes Western civilization.
Whether that dwindling light of freedom, which America long stood for, ever gets rekindled will largely come down to what happens in several months from now. It is our duty to continue to spread the truth, the perennial enemy of tyranny, in the lead-up to the election. We need to continue to expose the utterly fake narrative about J6, which was completely discredited for the garbage propaganda it always was by the (partial) release of January 6 footage.

We need to keep the momentum going strong behind President Trump and remain vigilant of left-wing fraud and scheming, which will surely get more desperate as they lose control of the narrative and see all their lawfare prove ineffective.
We must pray for the country, for the President, and for each other—and especially for the victims, including those still locked up—and for the wives and children of many victims, who continue to endure unspeakable hardship—financially and emotionally—each and every day.

We must also, and this is important, remain unified as a movement. Together, we are much stronger than if we merely proceeded individually. A strong, happy, and united front is what the Left fears most about President Trump and his supporters, which is why they are doing everything in their power that they possibly can to bring him down once and for all.
Let us send a clear and unwavering message to them that they cannot break our resolve whatsoever. We are stronger than ever before. They will be met with resistance unlike anything they have ever experienced if they so much as dare attempt to stop our momentum or strike any one of us down. We should accept nothing less than victory, because out of that victory will come true justice—the justice all these political hostages and their families have long waited for and so much deserve.

Rep. Barry Loudermilk is investigating security failures on Jan. 6 and hopes to bring 'just the facts of what happened'​

The House investigation into "what really happened" on January 6, 2021, is entering a "new phase," Fox News Digital has learned, with Rep. Barry Loudermilk leading the charge and vowing to bring "the truth" to the American people.
Loudermilk, R-Ga., the chairman of the House Administration Committee’s Oversight Subcommittee, told Fox News Digital that his investigation, which began under former Speaker Kevin McCarthy, is expanding with the support of House Speaker Mike Johnson.
"We’re entering a new phase," he said in an exclusive interview with Fox News Digital. "The speaker has committee whatever resources we need to move forward, and has basically tripled the size of our staff."

"We are investigating what really happened on January 6 and how were these people — whoever they were — how were they able to get into the Capitol? What was the security failure?" Loudermilk said, adding that the panel is also investigating "the actions of the Select Committee [on January 6] and how they conducted their investigation."
"Because the American people have a right to know what happened," Loudermilk said. "My main goal is to get the truth out there and give the American people the ability to make their own determination on this with facts — not with preconceived ideas or pre-determined narratives — but just the facts of what happened."
Loudermilk told Fox News Digital that last Congress’ House Select Committee on January 6, led by Democrats, "went above and beyond the evidence to try to prove something that they wanted to be truth."
Loudermilk said that panel "cherry-picked" evidence and "excluded evidence that did not support their narrative, which was that Trump and the Republicans are the ones who planned and carried out and assisted in the attacks on the Capitol."
"But there isn’t evidence to support that so-called truth," he said.

"Look, I’m not here to vindicate anyone," he said. "But we want the truth to prevail."
While the attacks on the Capitol took place three years ago, Jan. 6 has become a major talking point and issue for the 2024 presidential election cycle.
Former President Trump has been charged out of Special Counsel Jack Smith’s investigation into Jan. 6 and the 2020 election. Trump is charged with conspiracy to defraud the United States, conspiracy to obstruct an official proceeding, obstruction of and attempt to obstruct an official proceeding, and conspiracy against rights.
Trump pleaded not guilty to all charges.
And while the 2024 GOP frontrunner has never been charged with inciting insurrection, several states across the nation have attempted to use the 14th amendment to remove him from state ballots.
Meanwhile, President Biden’s first re-election campaign speech last week was focused on Jan. 6, and accused Trump of being a threat to democracy due to the Capitol riot, again claiming he incited the violence.

"It is imperative at this point because we do have a major election," he said. "I am not trying to influence the election but it is important that the people are really informed."

Loudermilk pointed to a Biden campaign commercial, using footage from Jan. 6.
"He’s using images of the gallows that was erected — that’s something we’ve been investigating. It was erected at 6 in the morning — how in the world did it stay up all day long? Right with Capitol Police there?" He asked. "That is something that at first sight, somebody should have been taking down."
Loudermilk said that "regardless of who did the attack, how did these people get in?"
Loudermilk said he is investigating the "security failure."
"We do know there was plenty of intelligence that there was going to be an attack on the Capitol. So Secret Service knew of it. The FBI knew of it. Department of Defense had intelligence. Homeland Security had intelligence. That intelligence was sent to the Capitol Police Intelligence Division—but it never got passed on any further. The chief did not know about it," he explained.
"Now whether it was intentional suppression or if it was incompetence, there was a huge cover-up over that," he continued. "We are looking at that, but from what we can tell, there were groups that were planning this attack on the Capitol."
Loudermilk also said they have intelligence that there were federal agents embedded in the crowd, which he noted, is "not unusual for large gatherings."

"But our issue is, if a plainclothes law enforcement officer engaged in nefarious activities, which we have already proven there was one Metropolitan police officer who was plainclothes on duty and encouraged people to go to the Capitol — so that type of activity is very concerning to us," he said.
But Loudermilk noted that federal officers "are not allowed on Capitol Hill unless they are invited by Capitol Police or the Capitol Police Board."
"Were any of those federal officers here before the chief of police asked for mutual assistance?" He asked.

Meanwhile, Loudermilk said the term "optics" comes up "way too often in a lot of the communications."
"People had a concern of the ‘optics’ from the Civil Defense unit to Capitol Police wearing riot gear — someone didn’t like that. I suspect it came from [then-Speaker Nancy] Pelosi’s office," he said. "We’re tracking that down. But they were told to leave their riot gear in buses — it doesn’t do any good. You don’t have time to tell people storming the Capitol, ‘hey, wait until we go get our defensive gear on.’"
"So the term ‘optics’ also comes up when it comes to the deployment of the National Guard," he continued. "We have uncovered evidence that Trump was aware of the attack on the Capitol and did order the National Guard to be ready to deploy, so we’ll be coming out with that as well."

As for the portion of the investigation focused on the now-closed House Select Committee on Jan. 6, Loudermilk said he was even "falsely accused" by the committee "of giving reconnaissance tours of the Capitol." He called those claims "asinine," but said that experience gave him "insight of how that committee was operating and I was able to see how they manipulated device, cherry-picked evidence, and even edited evidence in my case."

Loudermilk said that the first phase of the investigation was "laying the groundwork."
"The select committee was supposed to preserve all of these documents, all of the videos of depositions — what I expected, is when they handed all of the information over, was that we would have their entire database—that’s not what we got," he explained. "We got boxes of about 2 million printed pages of documents just placed into boxes without any cataloging or categorization. We had about two terabytes of digital data."
Separately, Loudermilk said members of that committee "took out liability insurance, meaning that they can’t be held liable for anyone that may have been defamed in their accusations or false reporting."
"It’s just interesting to me that they took out the liability insurance after the fact, if their reporting is so accurate, why would you be concerned about it?" Loudermilk asked. "
"The American people have the right to know the truth of what happened on January 6 and we have taken this from a very non-biased approach."

The Blaze just dropped a massive bombshell that, if true, further threatens the foundation of the Democrats’ Jan. 6 narrative.
“Thanks to new House Speaker Mike Johnson, We now have permission to release Capitol CCTV footage proving that a member of Nancy Pelosi’s security detail, Special Agent David Lazarus, perjured himself on the stand during the Oath Keepers trial,” the outlet posted Monday on X.

The Oath Keepers were one of the groups present at the Capitol on Jan. 6. Many members were charged with and found guilty of serious felonies for their actions that day, including seditious conspiracy.

The former House Select Committee on Jan. 6 deleted more than 100 encrypted files from its probe just days before Republicans took over the majority in the House of Representatives, Fox News Digital has learned.
The House Administration Committee's Oversight Subcommittee is leading an investigation into Jan. 6, 2021, led by Chairman Barry Loudermilk, R-Ga. The panel is investigating the security failures on that day, as well as the "actions" of the former select committee investigating the Capitol riot.

Sources familiar with Loudermilk’s investigation told Fox News Digital that, per House rules, the former select committee, which was chaired by Rep. Bennie Thompson, D-Miss., was required to turn over all documents from its investigation to the new, GOP-led panel, after Republicans secured the majority of the House of Representatives following the 2022 midterm elections.

Sources told Fox News Digital that Thompson had told Loudermilk that the select committee would turn over four terabytes of archived data, but that the new committee only received approximately two terabytes of data.
Fox News Digital has learned that Loudermilk’s committee hired a digital forensics team to scrape hard drives to determine what information they were not given.
The forensics team, according to sources familiar with their search, determined that 117 files were both deleted and encrypted. Sources said those files were deleted on Jan. 1, 2023 – just days before Thompson’s team was required to transfer the data to the new committee.
Fox News Digital has learned the forensics team has recovered all 117 deleted and encrypted files. Now, Loudermilk is demanding answers and passwords to access the data.

Fox News Digital exclusively obtained a letter Loudermilk sent to Thompson, requesting access to recovered digital files by his forensic team.
"As you acknowledged in your July 7, 2023 letter, the Select Committee to Investigate the January 6th Attack on the United States Capitol (Select Committee) did not archive all Committee records as required by House Rules," Loudermilk wrote. "You wrote that you sent specific transcribed interviews and depositions to the White House and Department of Homeland Security but did not archive them with the Clerk of the House."

Loudermilk added that Thompson also "claimed that you turned over 4-terabytes of digital files, but the hard drives archived by the Select Committee with the Clerk of the House contain less than 3- terabytes of data."

Loudermilk explained that after a forensic analysis of the data and archived hard drives, he was able to recover "numerous digital records from hard drives archived by the Select Committee."
"One recovered file disclosed the identity of an individual whose testimony was not archived by the Select Committee," Loudermilk wrote. "Further, we found that most of the recovered files are password-protected, preventing us from determining what they contain."
Loudermilk asked that Thompson provide him "a list of passwords for all password-protected files created by the Select Committee" so that his committee can "access these files and ensure they are properly archived."
Meanwhile, Loudermilk also penned letters to White House general counsel and the general counsel of the Department of Homeland Security, requesting "unedited and unredacted transcripts" of White House and DHS testimony to the former select committee.
Loudermilk's committee knows the transcripts of these interviews exist, but said they were not turned over by the Thompson-led committee.
Loudermilk demanded the White House and DHS comply with his request by Jan. 24.
"It’s obvious that Pelosi’s Select Committee went to great lengths to prevent Americans from seeing certain documents produced in their investigation. It also appears that Bennie Thompson and Liz Cheney intended to obstruct our Subcommittee by failing to preserve critical information and videos as required by House rules," Loudermilk told Fox News Digital.
"The American people deserve to know the full truth, and Speaker Johnson has empowered me to use all tools necessary to recover these documents to get the truth, and I will."

Even though Secret Service and Metro Police were alerted to device by fellow officer, they still waited up to four minutes before investigating device.

Rep. Thomas Massie (R-Ky.) confirmed the person who discovered a pipe bomb at the DNC on January 6th is a current U.S. Capitol police officer, raising questions as to why police didn’t immediately respond to his report.
Rep. Massie made the revelation during an appearance on Rep. Matt Gaetz’s (R-Fla.) Firebrand podcast Tuesday, saying he’d made the discovery earlier in the day.

“I learned that ‘backpack guy,’ January 6th backpack guy – not to be confused with January 5th backpack person – backpack guy was a non-uniformed, plain clothes police officer in… the employ of the Capitol Hill Police.”
Massie highlighted the absurdity that, even though the US Secret Service and DC Metro Police were alerted to the device by a fellow officer, they still waited up to four minutes before beginning their investigation of the device.

“I’m trying to give [them] the benefit of the doubt when they took four minutes, you know, they finished their lunch before they went and dealt with this pipe bomb,” Massie said. “I wanted to give them the benefit of the doubt and think that, well, if it’s just some random passerby and he said, ‘Hey, there’s something shiny over there. Could be a lawn sprinkler, you know, not sure maybe want to check it out,’ but that’s not what it was. It was a person who was, they say – again when I relate this to you, I’m relating what the Capitol Police have told me – they say it was a Capitol police officer who found this bomb, and that he told them it was a bomb. And he radioed it in, said, we’ve got the device, we found another device.”
Footage released earlier this month by Rep. Massie showed police behaved bizarrely and appeared to lack urgency once informed of the bomb.

Massie’s revelations come as news broke Tuesday that the FBI blocked one of their surveillance teams investigating the pipe bomb incident from interviewing the suspect tied to the case, according to a former FBI agent.
Former FBI agent Kyle Seraphin told the Daily Wire that his surveillance team used the security footage to track the suspect’s movements shortly after he placed the bombs.
Seraphin said he requested from FBI leadership permission to interview the suspect but was denied, and told to go after other J6 participants instead.
The pipe bomb narrative is one of the feds’ weakest links in the Jan. 6 situation and has the potential to expose criminal elements inside the Deep State that aimed to foment chaos that day, possibly in efforts to lay blame on a MAGA supporter.
