Dershowitz: Trump Indictment Makes America ‘Look Like Banana Republic Land’​

Constitutional lawyer Alan Dershowitz blasted special counsel Jack Smith’s latest 4-count indictment against former President Donald Trump related to the 2020 election as the beginning of “banana republic land.”

Dershowitz said on FBN’s “Kudlow” that the federal indictment makes Joe Biden appear “afraid of the democratic process.”

“We know that President Biden urged his attorney general to indict the man who he knew was going to be the leading opponent if against him,” Dershowitz said Friday.

“That begins to look like banana republic land. That’s what happens when people in power are afraid of the democratic process. What they do is they seek the indictment and prosecution of the people who are running against them.”

Dershowitz went on to argue that he has the right as a U.S. voter to vote against Trump and that right shouldn’t be left up to political prosecutors.

“I have a constitutional right to vote against Donald Trump for the third time,” he continued. “I voted against him twice, I intend to vote against him again, but I want to have that right to vote against him and not have that right taken away from me by prosecutors and by the president, who wants to see him imprisoned. That’s just not the American way.”

When asked by guest host David Asman if America was now a banana republic, Dershowitz responded that the choice of venue for the trial and the highly partisan makeup of the court — including the anti-Trump judge — gave that impression.

“We’re not there yet, but this is a step in that direction, and also placing the case in the District of Columbia, which is 95% anti-Trump, putting it in front of a judge with a history of anti-Trump,” he said.

“If the government thinks they have a strong case, they ought to join the defense and agree to move it to West Virginia or Virginia and put it in front of another judge who doesn’t have a long history of anti-Trump attitudes.”

“So, I don’t believe he can get a fair trial in the District of Columbia. And this indictment is deeply, deeply flawed. The government will have to prove beyond a reasonable doubt did he actually believe that he had genuinely lost the election,” he added.

Trump was arraigned last Thursday where he pled not guilty and his next hearing for this particular case is scheduled for August 28.

The judge assigned Tuesday to handle special counsel Jack Smith’s 2020 election case against former President Donald Trump poured thousands of dollars into Barack Obama’s campaign coffers, records show.
Trump faced an indictment at the hands of a federal grand jury in Washington, D.C., on Tuesday on four new charges related to his alleged efforts to challenge the results of the 2020 presidential election and incite the Jan. 6 riot on Capitol Hill in 2021. U.S. District Judge Tanya Chutkan, who will handle the case, was an Obama appointee in 2014 and contributed roughly $4,300 to his presidential campaign and victory fund combined between 2008 and 2012, according to campaign finance disclosures reviewed by the Washington Examiner.
Chutkan’s donations were made while she worked at Boies Schiller Flexner, a major law firm with over a dozen offices across the United States. She also in 2008 gave $250 to the campaign for Sen. Kirsten Gillibrand (D-NY), though the Federal Election Commission database doesn’t list her backing any federal candidates after September 2012.
Obama Judge Tanya Chutkan has a horrible record. She oversaw Mueller gang’s corrupt Butina case.
In 2019, Judge Chutkan was given the Mueller gang’s case against Russian Martina Butina.
On July 18, 2018, the New York Times reported the following in an article entitled “Maria Butina, Suspected Secret Agent, Used Sex in Covert Plan, Prosecutors Say”

Maria Butina was sentenced to 18 months in prison after pleading guilty to conspiring to act as a foreign agent, admitting that she was part of a Russian effort to influence U.S. politics. But she was hardly a shadowy figure. Here’s what her online profile revealed.
For four years, a Russian accused of being a covert agent pursued a brazen effort to infiltrate conservative circles and influence powerful Republicans while she secretly was in contact with Russian intelligence operatives, a senior Russian official and a billionaire oligarch close to the Kremlin whom she called her “funder,” federal prosecutors said on Wednesday.
But this was a lie and setup.
Judge Chutkan told the DOJ to provide Brady material to the defense in the case. But the DOJ said there was nothing to provide. Butina’s attorney’s specifically mentions Patrick Byrne specifically as being connected to the DOJ and yet this information was never provided to the defense team.

Judge Chutkan apparently didn’t care. She also was apparently fine with Butina being placed in solitary confinement. Patrick Byrne came out and shared that he didn’t think Butina was a spy of any sort but this didn’t matter to the Chutkan court. Butina was sentenced to 18 months in prison.
Judge Chutkan also oversaw the Pakistani spy ring case and gave those spies no time in prison because they were connected to the Democrats.

In 2020, TGP reported that a Pakistani spy ring had infiltrated the House Dems and that this was one of the biggest scandals in US history. Yet, this entire egregious breach of security went unpunished, because Democrats were involved.

Democrat US Representative Debbie Wasserman Schultz employed Pakistani IT staffers and brothers who were paid over $4 million dollars over the course of their employment even though they were accused of a cyber-security breach.

TGP reported in February 2020 that:
In July 2018, criminal Pakistani IT worker, Imran Awan pleaded guilty to making a false statement on a loan/credit application.
The Feds subsequently shut down everything else related to the Pakistani House IT scandal.

In a hearing in August 2018, Tanya Chutkan, an Obama-appointed federal judge, gave Debbie Wasserman Schultz’s Pakistani IT staffer Imran Awan no jail time because he had already “suffered enough.” Awan only served 3 months of supervised release.
Imran Awan’s lawyer Chris Gowan, who is a former aide to Hillary Clinton, trashed president Trump and other Republicans in a letter after the case was closed.
Chutkan has been horrible in prosecuting Trump supporters from Jan 6 who walked in the Capitol, punishing them with some of most egregious sentences.

Newsweek was apparently happy to see Judge Chutkan over the case in DC. Their report ignores Chutkan’s obvious bias and horrible record. Instead, Newsweek shares:
Chutkan, who was appointed to the Washington, D.C., district court in 2014 by former President Barack Obama, was chosen to oversee Trump’s criminal trial. Among legal experts, her presence has been deemed a major blow to Trump and a major boon for the DOJ, given her recent history of handing out some of the harshest punishments to participants in the January 6, 2021, Capital riot. Additionally, she has already denied the Trump legal team’s request for an extended deadline to respond to a protective order that could limit what the former president and his legal team can share publicly about the case.

Former President Donald Trump’s campaign released a blistering ad on Friday slamming prosecutors pursuing cases against him as “the fraud squad” that is doing the political bidding of President Joe Biden.
“How far will the most corrupt president in history go to keep Republicans from winning back the White House?” A narrator states at the top of the ad. “Meet the cast of unscrupulous accomplices he’s assembled to get Trump.”

The video features Manhattan District Attorney Alvin Bragg, Special Counsel Jack Smith, New York Attorney General Letitia James, and Fulton County District Attorney Fani Willis. It will run in television markets in Washington, DC; New York; and Atlanta, Georgia, a Trump aide said. Notably, those markets are where much of the legal action is taking place.
The narrator dubs Bragg a “radical liberal New York prosecutor who refuses to prosecute violent criminals” in the clip. Bragg’s office is pursuing 34 counts of falsifying business records against the 45th president. Legal minds and some of Trump’s ardent critics have questioned the foundation the case is built upon.
Smith has headed up two investigations into Trump – one into the classified documents he allegedly took to Mar-a-Lago at the end of his presidency and another into the January 6, 2021, Capitol riot. Both probes yielded indictments. The Trump campaign’s video argues he “has made a career persecuting innocent Republican officials.”
Notably, Smith headed up an investigation into former Gov. Bob McDonald (R-VA). Prosecutors won the case, convicting McDonald on corruption charges that the Supreme Court later overturned. Chief Justice John Roberts wrote in the opinion that “this case is distasteful,” adding “it may be worse than that,” as Politico noted.
James is pursuing a $250 million lawsuit against Trump and his two eldest sons, Donald Trump Jr. and Eric Trump, and said this week it “is ready for trial.” The advertisement highlights that James campaigned on promises to bring a lawsuit against Trump.
The ad then points to Willis, who many predict will bring charges against the 45th president, alleging he meddled in the 2020 election, slamming her as “Biden’s newest lackey.”

Precious metals expert and financial writer Bill Holter says there is a long list of financial trouble coming to America sooner than later.

There is the commercial real estate implosion, rising interest rates, an exploding federal budget, banana republic political problems, but the at the top of the list is the monster unpayable debt problem and the soon-to-be failing U.S. dollar. Holter says, “You can’t have a third of the federal taxes paid out in interest, and that number is only going to grow over time..."
"If the markets would not collapse ahead of time, which they certainly will, but if they did not, we would get to the point where the interest would eat up all the tax receipts. That is a mathematical impossibility. We’re broke...
On the other side of it, we have two rules of law.
We have one rule of law if you are a liar from the left and another rule of law if you are a conservative and you don’t support the bull crap rules they are putting out there...
This is an illustration that this country has already become a banana republic. The problem with that is the dollar issued by this country is the world’s reserve currency. It’s a huge problem.”
Holter says the dollar is going to take a big hit in the next financial crisis that has already started. When it hits, Holter predicts,
“The actual bottom line is dollars are just pieces of paper backed by our government.
The dollar is backed by the full faith and credit of a bankrupt insolvent government, and people will figure that out very quickly.
When it comes to survival, people are not going to give up something real for nothing...
We are in the weeds right now because of interest rates . . . look at mortgage rates, they are well over 7% for a 30-year mortgage. So, that’s going to hurt housing. Commercial real estate has already been destroyed...

I think we are in the weeds because interest rates are at a point that nothing can be refinanced and rolled over.”
In closing, Holter says, “This is not my opinion, it’s a mathematical equation..."
" The debt cannot be paid back. It’s not possible. We will default one way or another. We will print the crap out of the dollar and devalue it, or outright nonpayment.”
Holter predicted years ago we would end up in a “Mad Max” scenario when credit dries up and store shelves empty. Holter contends that credit is drying up with the money supply shrinking for eight straight months. The “Mad Max” world Holter is still predicting is now looking like it’s going to come true sooner than later.

Letitia James Trying to Nail Trump for ‘Losses No One Ever Suffered,’ Former Fed Prosecutor Says​

Former federal prosecutor Andrew McCarthy argued that New York Attorney General Letitia James and Manhattan Supreme Court Justice Arthur Engoron are “inventing losses no one ever suffered” to try to “get Trump.”
This week, former President Donald Trump testified in the civil fraud case brought by James alleging that he and the Trump Organization inflated the values of his properties to secure more favorable loan terms.
James wants $250 million in penalties and a ban on Trump and his company doing business in New York.

Before testifying Monday, Trump told reporters that his company’s financial statements were “very conservative,” adding, “So therefore there’s no fraud.”
Further, the 45th president explained that his property valuations have a “big disclaimer clause” instructing would-be lenders to do their own due diligence to determine what they believe the assets are worth.

After testifying, Trump said, “There’s no case here. There are no victims. The banks aren’t a victim. The insurance companies aren’t a victim. Everybody got paid.”
“The attorney general of this state is a disgrace. Letitia James is a disgrace to our country and to the state of New York,” Trump added.
“She should focus on all of the violent crimes and the murder going on in New York, not on somebody who paid back the banks in full without a default and in many cases paid them back early,” he said.
In September, Engoron ruled by summary judgment — meaning before there was any trial — that Trump and the Trump Organization committed fraud against lenders and insurers by inflating the values of the company’s properties.
The judge is now holding a non-jury trial to decide what penalties he should impose on the former president and the Trump Organization.
Last week, James’ attorneys called a bank expert who testified that the Trump Organization saved $168 million in loan interest payments by not accurately stating the value of its properties.
McCarthy is not buying it.
“Patently, there are flaws in the James-Engoron theory,” he wrote in a National Review article published Tuesday.
“First, if there were proof that Trump had ripped banks off in this manner and to this extent, this would have been a huge criminal case that no prosecutor’s office would pass up — certainly not the famously aggressive feds in the Southern District of New York (where I worked for two decades),” McCarthy said.
He continued, “and certainly not the Manhattan District Attorney’s Office, which twice litigated all the way to the Supreme Court to get Trump’s financial records, and which was not too embarrassed to bring a ludicrous indictment over the comparative chump change ($130,000) in hush-money Trump paid to a porn star.”
McCarthy went on to argue, as Trump has, that “banks in high-end lending are sophisticated financial actors who do not take the debtor’s word for it when it comes to valuing assets — they have entire departments of experienced appraisers assessing values.”
So he asserted that the banks were not tricked into loaning money to the Trump Organization.
To put a nail in the coffin of the case, McCarthy noted that even if Trump’s properties were overvalued, “there is no evidence that the banks would have charged a higher interest rate.”
He explained that the banks set the terms of their loans based on multiple factors, such as Trump’s history of paying up, the knowledge that he could shop around for other banks if their interest rates were too high, and the fact that they’re in the business of making loans to earn money.
McCarthy further observed that if the banks truly felt Trump had defrauded them out of millions of dollars, they would have sued him and the Trump Organization themselves.
The former prosecutor concluded, “It’s an amazing thing to watch: Donald Trump, front-runner in the Republican presidential nomination race, is on trial for supposedly inventing wealth that he didn’t have; and in order to nail him, elected Democrats Tish James and Arthur Engoron are inventing losses that no one ever suffered.”
Trump’s legal team sought a directed verdict on Thursday, asking Engoron to dismiss the case based on evidence presented at trial, including Trump’s testimony on Monday.
Trump’s attorney Christopher Kise argued that state lawyers had failed to meet “any legal standard” to prove allegations of conspiracy, insurance fraud and falsifying business records.
