1st ID soldier faces rape, attempted murder charges

A 1st Infantry Division soldier is being held in a military jail after being arrested by the German police on charges of rape and attempted murder.

The soldier, whose name has not been released, was arrested Thursday in connection with an incident that allegedly occurred last weekend near a nightclub in Hirschaid, Germany, according to 1st Infantry Division news release.

Hirschaid is about 10 miles south of Bamberg.

On Monday, a 20-year-old woman was found unconscious near a commuter parking lot, according to a German police news release, which was translated into English and provided to Stars and Stripes by the 1st ID public affairs office.

The Bamberg police, wo
rking with the Army's Criminal Investigative Command, established a special investigation team to look into the alleged crime. Following an initial evaluation of the evidence, police questioned several U.S. Americans who are stationed in the Schweinfurt area, the released stated.

After the questioning, police arrested a 22-year-old man on charges of attempted murder, rape and aggravated assault, according to the release. The soldier is being held at the Mannheim Confinement Facility, according to 1st ID officials.

German police officials are still investigating the case and are looking for anyone who may have seen the woman and the soldier together last weekend at the nightclub.

(Note - I still could not find a pic of this beast, but he should have been locked-up a long time ago. Looks like he will be out again soon and it will be back to the "same old-same old" until he actually kills someone. Then maybe, maybe he will spend some significant time behind bars.)

WÃԠ’Ô� ’Ãâ┚¬¦“RZBURG, Germany — A Schweinfurt-based soldier will spend the next year in jail after being convicted Thursday of attacking a German woman outside a nightclub in November 2005.

A court-martial panel determined that Pvt. Kwame H. Ottley, 23, was guilty of aggravated assault with means or force likely to inflict death or bodily harm.

He was sentenced to 36 months’ confinement, but because of a pretrial agreement, he’ll serve no more than a year in jail for the crime. He had faced a maximum punishment of life in prison if convicted of a more serious charge of attempted premeditated murder.

Ottley’s court-martial lasted four days.

The attack took place outside the Fun Tower discotheque near Hirschaid. The victim was found at around 8 a.m. on Nov. 14, 2005, by a woman walking her dog, said Capt. Derrick Grace, lead trial counsel.

The victim had several life-threatening injuries, including a 5- to 6-centimeter cut on her chest, a nearly torn-off left ear and seven missing teeth, and was found naked below the waist, testified Dr. Elizabeth DeWald, the on-scene emergency physician. She said the victim was not sexually assaulted.

Medical officials testified that many of the victim’s injuries were caused by a 100-pound rock — slightly larger than a basketball, full of jagged edges and stained with dried blood — that sat on an evidence table in the middle of the courtroom for the majority of the trial.

A prime suspect from the beginning of the investigation, Ottley admitted to having been outside the club with the victim that morning.

Claiming it was a sexual liaison gone awry, Ottley pleaded guilty to assault consummated by battery for shoving Lopez and leaving without making sure she was all right.

“I fully take responsibility for shoving her down, for which I pled guilty to, and if she were here, I would tell her I was sorry for shoving her down to the ground and not going to check on her,"� Ottley said before the panel deliberated sentencing.

Ottley also was convicted of breaking restriction that night, having been previously ordered to stay within the limits of the Schweinfurt military community because of pending legal action stemming from a knife incident in May 2005.

In January 2006, he was convicted of stabbing another soldier at another nightclub. He received a four-year prison term and a bad-conduct discharge for that conviction.
