CLEVELAND -- Trial motions were decided Friday in the case of the man accused of killing Shakira Johnson.
Daniel Hines will have to face all of the key evidence against him.

Judge Thomas Pokorny will allow a jailhouse informant to testify against Hines. The informant says Hines confessed to him.

Daniel Hines to appear in court for attempted rape

CLEVELAND -- A learning-disabled handyman acquitted of the kidnapping and killing of an 11-year-old Cleveland girl will be back in court Monday.

This time, 26-year-old Daniel Hines is accused of trying to rape his 13-year-old cousin months before Shakira Johnson was killed in 2003.

The trial will be held in the same Cleveland courtroom where Hines was acquitted in December in Shakira's death. Her disappearance from a block party on September 13th, 2003 led to a weeks-long search involving community groups, police and FBI agents.

Police say Hines fondled a cousin at a relative's house on July Fourth, 2003. Hines' lawyer says he has evidence his client wasn't there that day.

CLEVELAND -- The man acquitted in the murder of 11-year-old Shakira Johnson is now on trial for an unrelated attempted rape charge.

NewsChannel5's Paul Kiska reported that on Thursday, Daniel Hines took the stand in his own defense for the first time.

Hines is charged with gross sexual imposition and attempted rape for an alleged incident involving his 13-year-old cousin in July 2003.

Hines denied on the stand investigators' claims that he used a knife as a weapon against his alleged victim.

He also denied using a crowbar as a weapon against the brother of his alleged victim.

Kiska said Hines was on the stand fo
r 1½ hours, where he was grilled by the prosecution.

The defense is claiming that Hines was not at the home the day of the rape.

The 13-year-old alleged victim took the stand earlier this week, and so did her brother.

Testimony will continue Friday.

Hines was found not guilty in December for the 2003 kidnapping and murder of Shakira Johnson. Hines did not take the stand in his own defense in the murder trial.

CLEVELAND -- The jury in the Daniel Hines attempted rape trial told a judge Tuesday that it is hung on three of the charges against the Cleveland man.

Hines was charged with attempting to rape his 13-year-old cousin in 2003.

The jury found Hines not guilty on four counts of assault stemming from prosecutors claims that he beat up his cousin's brother when he tried to intervene.

But the jury was unable to reach a verdict on four charges of attempted rape, kidnapping, gross sexual imposition and disrupting public service.

The jury deliberated for three hours on Friday and all day Monday without reaching a verdict. Jurors told the judge Monday that they were at an impasse on three charges, but the judge at that time asked them to
continue deliberations.

By midday Tuesday, t
he jurors told the judge that they were still deadlocked.

Prosecutors plan to retry Hines on the four charges. Hines' defense attorneys are asking that his bond be reduced. He remains jailed on $100,000 cash bond.

Hines was previously tried for the kidnapping and murder of 11-year-old Shakira Johnson in September 2003. A jury acquitted him in December.
