Attorney For Local Murder Suspect Wants New Judge
Supreme Court Ruling Expected This Week
LOUISVILLE -- Attorneys representing a murder suspect in Jefferson County want the Kentucky Supreme Court to remove the judge in the case.

WLKY NewsChannel 32's Bill Alexander reported Tuesday.

Monday, Gary Hearn's lawyer filed a motion with the Kentucky Supreme Court, asking that Judge Martin McDonald be removed from the case

. According to lawyers, McDonald had a conversation with a courtroom deputy about a defense motion for separa
te trials for the brothers.

The judge reportedly conceded that the defense attorneys were right in their arguments, but McDonald said he was not going to try the two separately, according to Alexander.

Defense attorneys said they believe McDonald is ignoring the law.

The judge is no stranger to controversy. During a recent murder trial for Firis Al-Kurdi, who was charged with killing a man for robbing his store, McDonald referred to the robber and shooting victim, James Abdul-Shajee, as an animal.

The charges against Al-Kurdi were dismissed.

The Supreme Court ruling could come down this week.
