COLUMBIA, Tenn. (WTVF) — An assault in the parking lot of a Columbia Popeye's ended with one person in custody and another in the hospital.

The assault happened Tuesday at the Popeye's Louisiana Kitchen on Nashville Highway, and on Friday, officers arrested and charged 29-year-old Deriance Ra'Shaiel Hughes, who appears to be a Popeye's employee, with felony aggravated assault.

Columbia Police officers responded to a disturbance at the fast food restaurant around 5:30 p.m. Tuesday.

Cell phone video of the incident shows a crowd of people come out of the restaurant. In it, is Hughes holding a woman up in the air. He then can be seen lift her up even higher then throw her to the ground.

In an interview you’ll only see on FOX 17 News, the woman who was body slammed in a Popeyes parking lot is speaking out.

Video showing Deborah Staggs being brutally body slammed in a Popeyes parking lot in Columbia has been viewed thousands of times.

But until now, most have never heard from the woman herself. In the exclusive interview, Staggs talks about being double-victimized and the pain of her personal life. She explains why she's not a racist and why people think they heard a racial slur in the video leading up to her being body slammed.


Staggs doesn’t care if it helps or hurts her legal situation, she wants to tell her story. She wants people to know her heart.

It’s the tale of two videos. One shows a 56-year-old woman bodyslammed in the Popeyes parking lot by a man. In the other, she appears to be arguing with employees. With the confrontation inside the Popeyes, everyone has made judgements based on the videos.

Now, Staggs is recovering in an undisclosed recovery hospital due to death threats. Her arm is broken in 16 places. She has nine broken ribs, a shattered kneecap and a shattered life.

“I’ve missed my grandson’s three ballgames. I can’t get that back. My grandchildren are my life,” Staggs said.

She has watched news reports where several witnesses claim she used the n-word in a confrontation with Popeyes employees. She says that’s not true. She claims one employee told everyone she used the word and that escalated an argument over a $13.11 overcharge.
 
One can barely imagine the national media news orgasm if a white manager had body slammed an elderly negro female....that video of her hitting the ground is very disturbing and I don't care if she did call some spook a nigger!!!

A former Popeyes Louisiana Kitchen employee convicted of slamming a customer to the ground outside the Columbia restaurant has been sentenced to four years in prison, following his conviction for charges of aggravated assault.

Deriance Ra’Shaiel Hughes received the maximum possible sentence for the charge, handed down by Maury County Circuit Court Judge Stella Hargrove on Thursday, according to records shared by the Maury County Court Circuit Court Clerk.
A video of the confrontation was shared across social media, showing Hughes slamming a 55-year-old woman to the ground on the parking lot pavement outside of the restaurant at 823 Nashville Highway in November 2019.
A description of the November 2019 incident released with the preliminary hearing said the argument began inside the fast food restaurant and then continued in the parking lot, where Hughes allegedly grabbed Staggs and slammed her on the pavement. The report said the injuries she sustained from the confrontation caused her to have two surgeries due to a broken arm, broken ribs and a possible fractured knee.
Following the incident, Hughes was released on a $20,000 bond. Before being released, Hughes served 10 days in the county jail for contempt of court after failing to appear when charged with driving on a suspended license earlier this year.
Court records show Hughes is represented by Columbia Attorney William C. Barnes Jr.


Court appearance

Hughes, 29, and Cheteka Miller, 32 — and the female patron who claimed to be the victim — Deborah Staggs, 55 — all went before a Columbia grand jury in May 2019.
All three were charged with assault.
Court records show Miller’s case was retired in October 2020 under the condition that she attend a mandatory anger management course.
Staggs’ case is scheduled for a juried trial on July 27 in Maury County’s Criminal Circuit Circuit Court.
A video of the incident went viral on social media and showed Miller hitting the customer from behind before being slammed to the ground.
A second clip was also posted to social media, showing Staggs and the staff arguing inside the restaurant before the physical altercation.
Staggs, said she suffered nine fractures, six cracked ribs and a broken knee, underwent surgery at Vanderbilt University Medical Center due to the injuries she suffered from the assault.
Multiple witnesses :rolleyes: who were inside the store where the conflict began say Staggs used racial slurs inside the store when she was accidentally overcharged for her sandwich, according to reports.
Staggs’ attorney, Rocky McElhaney, told news outlets that his client denies using such language.
He said Staggs came back to the Popeye’s after checking her bank statement so that she could get a refund, and that the manager “immediately began insulting her.”

COLUMBIA, Tenn. (WZTV) — There are new developments in the viral video of a woman who was body slammed by a Popeyes employee in Columbia last year.
We now have brand new surveillance video about what happened in the restaurant that evening.
55-year-old Deborah Staggs suffered six broken ribs among several other injuries.

Now, attorney Rocky McElhaney says the new surveillance videos will help her case, showing the chain has been untruthful in its account.
In one video, McElhaney says you can see another employee fist-bumping accused attacker Derriance Hughes in the back room after the body slam.

In another, you can see Staggs standing at the counter with an employee yelling at her, but McElhaney says the 911 calls -- which happened at the same time -- paint another picture. We can hear the caller say that a woman was drunk, acting a fool, and was yelling, which McElhaney says is not true.
The official police report also shows a statement from an employee who was interviewed at the time, stating that she tripped and that he did not see anyone slam her.
