INDEPENDENCE TWP. - An illegal immigrant accused of running over and killing an off-duty Flint police officer in Independence Township had a blood alcohol content twice the legal limit, blood test results showed.


His attorney said Friday that second-degree murder is not an appropriate charge for the Mexican national, Ramon Felix Pineda, who has lived in the United States for more than a decade.

Attorneys on both sides stipulated to the blood results Friday morning as the preliminary examination for Pineda, 25, was adjourned until Sept. 28 by 52nd-2nd District Judge Kelley Kostin at the request of the defense.

Pineda, of Clarkston, is charged with second-degree murder in the Aug. 26 crash that killed Flint police Officer Vincent Owen D'Anna, 26, who died the following morning at Genysis Health Park in Grand Blanc.

The family and friends of a young Savannah woman, who was killed when a drunk driver swerved in front of her car, are finally getting some closure. They lost 21-year-old LaToya Holloway in February, 2006.

She was driving down Ogeechee Road. Two illegal immigrants driving an SUV were coming the other way. Garden City police say both men were drunk. Jesus Perez was driving, but the passenger, Felix Maldonado, grabbed the steering wheel, swerving the car across the center line. They slammed head on into Holloway's car, killing her.

The judge gave Perez 15 years. Maldonado, who pleaded guilty to vehicular homicide, was sentenced to ten years in prison on Tuesday.

Garden City police said what made the case more challenging, neither Perez nor Maldonado speak English. Chief David Lyons said there can also be an issue of trust when officers deal with illegal immigrants.

"They don't trust us, because they're not here legally," he said. "And they think everybody is out looking for them."

Lyons said they want to protect the entire community, even those who are here illegally. They also don't have the resources to deport illegal immigrants.

A Brownsville man arrested twice in one day remains behind bars with a laundry list of charges. Jesse Rodriguez faces a total of 7 charges for driving while intoxicated, evading arrest and assault on a public officer among others.

Brownsville police first arrested 42-year-old Rodriguez on Southmost Road on Thursday afternoon for allegedly driving while intoxicated.

From there, though, things only got worse for Rodriguez.

"When the officer left to transport him, he pulls them over after seeing him moving around further down the road," said Sergeant Juan Lopez from Brownsville's police department.

Rodriguez wasn't just being fidgety. Police said he was preparing his plan of attack on the officer.

"When he opens the back door the suspect pushes the officer and that's when the officer notices one handcuff came off," added Sgt. Lopez.

According to the police report, the officer and the suspect fell to the ground.

They struggled for a moment and then investigators said Rodriguez hit the officer on the head with his loose handcuff.

Rodriguez fled the scene and left the officer behind with minor injuries.

For nearly two hours, Brownsville's police searched the area until a tip finally leads them to the suspect about 10 miles away.

"We received information that he was on a house on Diamante St. and officers apprehended him there," said Sgt. Lopez.

Rodriguez remains in custody with his bond set at $40,000.

After racing, vehicle hit car of woman who died, Allentown police say.

A 29-year-old Allentown man has been charged with ramming his car into a woman's car -- which then hit a utility pole, fatally injuring her -- while they raced on a foggy city street at speeds of up to 75 mph.

Fabian Felipe Galan of 205 S. 13th St. was arraigned on vehicular homicide and related charges Friday, more than a year after his car collided with one driven by 20-year-old Judy Christoffers.

Galan and Christoffers left an Allentown bar on Sept. 24, 2006, court records say, and were barreling down Union Boulevard a little before 3 a.m. when his car hit hers near Fenwick Street.

Galan drove off after the collision, an affidavit of probable cause says, and later took his car to a body shop, telling his mechanic the sedan had been carjacked and damaged before it was recovered.

Police say such a carjacking was never reported.

Christoffers was pulled from the wreckage of her car and taken to St. Luke's Hospital-Fountain Hill. The Catasauqua woman died two days later of blunt force trauma to the head.

Galan is now being held in Lehigh County Prison without bail.

It took authorities more than a year to investigate the crash, then bring charges against Galan.

''This one was very lengthy, and it wasn't an easy investigation at all,'' Allentown police Capt. Daryl Hendricks said.

Investigators had trouble finding witnesses to speak about the crash, he said, and then officials spent time making sure they were confident they could prove their case in court.

Lehigh County District Attorney James Martin said Galan and Christoffers knew each other before the night of the crash. It's unclear how long, or how well, they knew each other. Well, if she was hanging out with this spic then it's sad but I have no sympathy.
Christoffers' passenger, Yesenia Rios of Allentown, then 19, survived the crash and told police Christoffers was arguing with someone on her cell phone before the wreck.

Her cell phone records show that she spoke with someone at a phone number registered to Galan for about 20 minutes before the crash, the affidavit says.

Records do not indicate whether she was speaking to Galan, though, or if they were speaking to each other when the cars collided.

Martin declined to say whether investigators believe Galan meant to hit Christoffers' car.

The affidavit says police found witnesses who saw Galan's and Christoffers' cars ''racing'' down Union Boulevard.

One woman told police she saw a car matching Galan's description hit Christoffers' car in a way similar to ''what police do on TV'' to stop runaway vehicles, the affidavit says.

Christoffers' car was severely damaged on its driver's side. Investigators later found tire marks on that side of the car, the affidavit says, and there's evidence Christoffers' car had been going as fast as 75 mph.

Galan is facing 16 criminal counts in Christoffers' death. Besides vehicular homicide, they include involuntary manslaughter, reckless endangerment and failing to give information or render aid following the crash.

When police went to his home Friday to serve a warrant, court papers say, they found a semiautomatic pistol, marijuana and drug paraphernalia. They filed separate drug charges against him later.

A suspect is now behind bars after failing to stop and render aid in a weekend hit-and-run accident that killed two people.

Guillermo Navarro, 26, the driver accused of killing two people in a hit-and-run early Sunday morning, was booked into the Travis County Jail around 10:30 p.m. Tuesday.

Police said it happened around 2 a.m. at the intersection of Gunter and Airport.

Herdes Lee Garner, 35, was pronounced dead at the scene. His passenger, Latanya Birdow, was taken to Brackenridge Hospital and later died.

This is Austin's 51st and 52nd traffic fatalities of 2007.

Placido Mauricio was found guilty of failure to stop and render aid. (News 4) There was a guilty verdict Friday afternoon in the case of a man accused of running down a woman pushing a baby stroller and then taking off.

Placido Mauricio was convicted of failure to stop and render aid. Mauricio hit Monica Espinoza with his SUV in September 2004 and left the scene. Espinoza died. The baby she was pushing in the stroller survived.

Espinoza's sister says she is happy about the guilty verdict, but she does not think the maximum sentence of five years is fair.

"I don't think it's enough time for him. Five years is nothing because he left two girls behind without a mom," said Patricia Espinoza.

The jury will sentence Mauricio on Monday. His punishment could range from probation to five years in prison.

16 Year Old Faces 20 Years In Prison

Jaime Arrellano was sentenced to 20 years in prison yesterday, after also pleading guilty to intoxicated assault charges.

Arrellano was tried as an adult after causing the accident which killed Martha Mondragon back in June. Mondragon was pregnant at the time.

Arrellano was also sentenced to 16 years for the death of her unborn child.

Police arrest Hobbs man in connection to a fatal hit and run accident

Police arrest a 20-year-old Hobbs man in connection with a fatal hit and run.

Abigail Balboa Maldonado was hit and killed this summer.

Investigators believe Bobby Ruiz was driving the car that hit the 22-year-old woman.

Last month, police issued a warrant charging him with failure to render aid.

Hobbs police say they arrested Ruiz over the weekend, when they pulled him over for a traffic stop.

It was a drunk driving crash so violent, it broke two people's legs and caused a woman to lose part of her intestines.

The suspected drunk driver has been charged with the crash, but has not been arrested. Why? Investigators believe he's on the run and may be headed to Mexico.

A month later, you can still see the skid marks right where that crash happened.

"When I hit the windshield, it split all of my arm, very wide open," explained Victor Orr, who was injured in the crash.

"The impact was so strong that they had to open me up," added Carmelina Orr.

Doctors say Carmelina and Victor Orr's bodies will never be the same because of the accident.

The crash happened on Highway 173 near Bandera last month.

A grand jury just indicted Felipe Neri Gonzales-Lopez on two counts of intoxication assault, for causing the near-deadly wreck. Deputies say Gonzales-Lopez may now be headed to Mexico.

"Wherever he's at, he could hurt anybody," said Carmelina."And if he's drinking and he has a problem with drinking and he gets behind a wheel, I'm hurt, but he could go out and kill somebody tomorrow."

The Orr's can't work now, and medical bills are piling up.

"Right now we need the public's help to find Mr. Gonzales-Lopez, who is on the run," said the Orr's attorney, Mitchell Ginsberg. "He has some insurance, but it's nowhere near enough to cover the injuries and damages that the Orr's have suffered."

The Orr's, who are newlyweds, said a drunk driver made their lives change in a flash.

"Today it's me. Tomorrow, it could be your son, it could be your daughter, it could be you," said Carmelina.

Bandera County investigators told News 4 Gonzales-Lopez is from Mexico, and they may be asking Texas Rangers to help track him down.

Suspect held after hit-and-run wheelchair crash

A 51-year-old man arrested for Wednesday morning's hit-and-run crash on Highway 99E, which killed a wheelchair-bound woman, appeared in court Thursday.

Suspect Rafael Avelino Gines

Rafael Avelino Gines was charged with felony hit-and-run and held on $250,000 bail. Authorities said there were also possible immigration issues.

Mary Denise Richey, 40, was in a wheelchair after getting off a Tri-Met bus and was struck at about 6 a.m. while attempting to cross Highway 99E south of Boardman Avenue.

Richey was dragged approximately 100 feet in her wheelchair, said Oregon State Police Lieutenant Gregg Hastings.

She was transported to Oregon Health Sciences University Hospital, where she died about an hour later.

The driver of the van was last seen southbound on Highway 99E.

Teen Driver in Fatal Thanksgiving Weekend Wreck Arrested

Raleigh — A 16-year-old wanted for more than a week in connection with a wreck that killed a woman and critically injured another teen was arrested Tuesday and charged with manslaughter.

Raleigh police located Joel Duran and took him into custody without incident, police spokesman Jim Sughrue said Tuesday.

Investigators believe drugs and speed possibly played a role in the Nov. 24 crash in which Duran was allegedly driving west on the I-440 Beltline between South Saunders Street and Rock Quarry Road when he passed a car, left the roadway, overcorrected and then flipped.

Elizabeth Arch, 23, of Raleigh, and Duran's cousin, Zepherino Duran, 17, were ejected from the sport utility vehicle he was driving. Arch died at WakeMed; Zepherino Duran was listed Tuesday in critical condition at WakeMed.

Duran had been the subject of a search since the accident. His address is listed in police records as Reconciliation Drive in Raleigh, but no one in the neighborhood admitted to seeing him since the crash.

He also faces a charge of assault with a deadly weapon inflicting serious injury for the injuries sustained by Zephrino Duran and driving without a license.

DENTON, Texas -- Police said a man was arrested after a hit-and-run killed a Hebron High School student Saturday night.

Police arrested Arturo Almora-Juarez, 33, after he crashed into the car of Trevor Schor, 16, who tried to make a U-turn on FM 544 near Plano Parkway to help someone change a tire.

Juarez drove away, but police said they caught up to him later.

Police said Almora-Juarez was charged with failing to stop and render aid and driving while intoxicated.

Students returned to Hebron High School Monday morning to learn of Schor’s death.

Almora-Juarez was out of jail Monday morning, according to police.

MIAMI -- The rapper Pitbull is in a Miami jail on charges of driving under the influence.

He was pulled over on the Palmetto Expressway on Friday morning near the Southwest 56th Street exit.

The 26-year-old, whose real name is Armando Perez, was booked into the county jail. He was released on $1,000 bond Friday afternoon.

Pitbull laughed and joked about the jail's conditions as he left.

"Five stars, baby," he said. "Cinco estrellas."

According to his arrest affidavit, he was driving 93 miles per hour southbound on the Palmetto Expressway in a silver Mercedes just before 3 a.m. The speed limit there is 55 miles per hour.

A Miami-Dade County police officer reportedly asked Pitbull five times to get out of the vehicle.

He finally responded with, "Comeon, Poppa, what's up?" the arrest affidavit said.

The officer said that's when he smelled alcohol on his breath. Pitbull refused a breathalyzer and failed his field sobriety test.

When he was arrested, he reportedly said, "This is a big waste of your time, Papo."

The Cuban-American mixes in both Spanish and English.

His latest CD, The Boatlift, is currently No. 24 on Billboard's chart of top independent albums.

The people at Pitbull's barbershop had only good things to say about him.

"He's my friend, he's a hardworking artist," his barber Josue Romero said. "Unfortunately he had to get arrested for the DUI, but you know, that could happen to anybody. He was probably out at the club having drinks, and unfortunately it was him."

"We all know he's a hard worker," friend Gus Plasencia said. "He's come up in this place."

The arrest affidavit said Pitbull did not know his own ethnicity when he was pulled over. He also did not know his weight, the color of his eyes, the color of his hair or his local phone number.

No court date has been set.

cRapper Pitbull is to plead not guilty to charges of driving under the influence following his arrest in Miami on Friday.

The Latrino hip hop star, real name Armando Perez, was booked at 3.14 am on Friday for doing 93 miles per hour in a 55 miles per hour zone.

According to official documents obtained by TMZ.com, he failed his sobriety tests and smelt of alcohol at the time of arrest.

But Perez, who has been released on $1,000 bail, is refuting the charges.

His lawyer Angela N. Martinez said in a statement on Friday, "With respect to Armando Perez' arrest this morning, this is to inform you that Mr. Perez will be pleading not guilty to all charges."

"This is all the unfortunate result of a misunderstanding. Mr. Perez and his legal team are confident that these charges will not be upheld."

A 22-year-old man is suspected of driving drunk and triggering an accident Wednesday that killed his three best friends and closed a mountain highway overnight.
It was just the type of tragic accident law-enforcement agencies throughout San Bernardino County are trying to avert during the holiday season by stepping up patrols and DUI checkpoints.

Jose Ricki Flores, who authorities said lost control of his vehicle at 8:41 p.m. as he rounded a curve on Highway 18, was taken to Loma Linda University Medical Center.

Authorities were waiting for test results on Flores' blood, but he is expected to be arrested on suspicion of gross vehicular manslaughter while intoxicated.

Flores and three passengers were south of Lower Waterman Canyon Road when he lost control of his 1991 Nissan Sentra, spun around and skidded backward into oncoming traffic, crashing into a 2006 Cadillac Escalade.

All three of Flores' passengers - brothers Moises Figuereo, 18, and Jose Figuereo, 17, and their cousin, Oscar Jareguy, 25, all of San Bernardino - were killed.

San Bernardino police Detective John Cardillo lamented the loss of life, disappointed that his department's DUI program didn't save these three.
 
Police: Drunken driver may be to blame for girl's death

A suspected drunken driver was behind bars Christmas Eve.

He is accused of causing a crash that killed an 11-year-old girl.

Police said 26-year-old Alejandro Sandoval of Katy was speeding when he rear-ended a Honda Accord on Barker Cypress.

Liliy No, from California was, in the back seat of that car. She was killed.

Three other people in the Honda were hurt, but will survive.

Sandoval is charged with intoxication manslaughter and is expected in court on Wednesday.

Woman, 19, booked after fatal crash on I-80 in Omaha

OMAHA, Neb. (AP) - A 19-year-old Omaha woman has been booked for felony motor vehicle homicide in connection with a crash on Interstate 80 in Omaha last night.

Analilia Sandoval-Avila lost control of her westbound 2004 Ford Contour and truck the concrete wall along the north shoulder of westbound I-80 near 42nd Street. The vehicle hit a light pole along the shoulder before stopping.

Police say for unknown reasons, Sandoval-Avila reversed her car across the westbound lanes of I-80 and was struck on the front passenger door by a 1998 Honda CRV.

Kyllie Rosas, a front-seat passenger in the Ford Contour, suffered critical injuries and died at a hospital.

The driver and three passengers in the Honda were treated for minor injuries, as were two other passengers in the Contour.

Sandoval-Avila was booked after being treated for her injuries.

A Mastic man was driving while intoxicated with his two young children in the vehicle when he nearly struck a phone company employee on Mastic Road, about 90 minutes into the New Year, Suffolk police said.

Michael Orlando, 31, of 58 Terapin Street, was arrested at about 1:25 a.m., after the 1999 Jeep he was driving north went through a roadblock, near Somerset Avenue, and almost struck a Verizon employee working at the location.

When officers interviewed Orlando, they noticed he was intoxicated and spotted his children, ages 1 and 6, in the car, police said.

Orlando was convicted in 1998 of operating a motor vehicle while under the influence of alcohol or drugs, police said.

He was to be arraigned Tuesday in First District Court in Central Islip on charges of driving while intoxicated, endangering the welfare of a child and reckless endangerment.

LITTLE ELM, Texas -- A neighbor's observation led to the arrest of a hit-and-run suspect Wednesday night.

Jason Fabbri stopped at King Road to help a driver who had crashed into a ditch on Dec. 11 when someone drove by and hit him.

Little Elm police arrested Mark Ybarra after one of his neighbors noticed Ybarra’s damaged truck and called the police.

Police said Ybarra might not have faced criminal charges if he had stopped.

Fabbri is still recovering from the injuries he suffered in the incident.

COLUMBUS, Ohio - A judge ordered a man charged in a crash that killed his pregnant wife and unborn child be held under $500,000 bond on Wednesday.

Alfonso Martinez was charged with two counts of aggravated vehicular, 10TV News reported.

Martinez ran a red light on Hayden Run Road at Riverside Drive at about 6 a.m. Tuesday, police said.

His vehicle was struck by an oncoming Ohio Department of Transportation truck.

Martinez's pregnant wife, Paulina, had to be extricated from the vehicle. She was taken to Riverside Methodist Hospital, where she was pronounced dead.

Three children who were in the car were also injured. Martinez's 2-year-old son was taken to Nationwide Children's Hospital in critical condition. Two other children, ages 4 and 7, suffered minor injuries, 10TV News reported.

The couple's children were placed in the care of Franklin County Children Services.

Investigators said Martinez, who is in the country illegally and does not have a driver's license, was drinking before the crash, 10TV News reported.

In court, Martinez's interpreter told the judge that he was "in shock" and that he led a happy life with his wife and children.

Martinez will be in court on Jan. 11.
