The accused West Side bike-path terrorist refused to stand as a Manhattan federal judge entered the courtroom Tuesday, despite his lawyer’s best efforts to get him to.

Sayfullo Saipov’s lawyer had motioned at him with her hand to get him to stand out of respect for the judge, as is courtroom protocol. But Saipov, 29, remained seated and stared stonily ahead.

During the proceeding, the murder suspect, who was dressed in a navy-blue suit and orange socks, bizarrely constantly nodded his head.

Prosecutors asked for a trial date of April 2019, but Saipov’s camp said they needed more time. The judge asked both sides to submit briefs by March 30 providing more information on the case
before making a decision.

The feds also were ordered to decide by Sept. 1 whether they would seek the death penalty for Saipov, who is accused of killing eight people in the attack.

Last week, Saipov’s lawyers indicated that their client would plead guilty in exchange for a life sentence without parole.

The accused lone-wolf terrorist, an Uzbek national, allegedly plowed his rented Home Depot truck down the popular bike path just after 3 p.m. Oct. 31, striking nearly two dozen pedestrians and cyclists.

He made it 17 blocks before crashing his truck into a bus near Stuyvesant High School and being shot by a cop as he fled, authorities have said. Saipov was allegedly screaming, “Allahu akbar!’’ — “God is great! in Arabic — as he ran.

Notes declaring his allegiance to ISIS — and a flag from the terror organization — were recovered from the truck, officials said. Saipov later allegedly asked cops if he could hang the flag in his hospital room while he recovered.

Saipov faces nine charges that carry either a guaranteed life sentence or execution.

Manhattan federal prosecutors have added six counts of attempted murder to the eights counts of actual murder facing the alleged West Side truck terrorist Sayfullo Saipov, according to newly filed court papers.

Prosecutors with Manhattan US Attorney Geoffrey Berman on Wednesday told a Manhattan federal judge that a grand jury has handed up yet another superseding indictment in the high-profile case, which accuses Saipov, 30, of using a Home Depot rental truck to mow down dozens of pedestrians while speeding through a bike-only path in lower Manhattan last Halloween — killing eight.

The Paterson, NJ, resident, who was arrested after he was shot by NYPD, asked if he could fly an ISIS flag inside his Bellevue Hospital room following the attack :rolleyes:, the feds have said.

On Wednesday, prosecutors said they added six counts of attempted murder in aid of racketeering, each of which carries a potential sentence of 10 years. They also added eight new counts of assault with a dangerous weapon in aid of racketeering, each of which carries a maximum term of 20 years each.

Saipov already faces the death penalty after he was slapped with eight counts of murder last year. He has also been charged with violence and destruction of motor vehicle, which also carries a potential death sentence.

The feds have asked that Saipov be arraigned on the new charges Friday.

His lawyer didn’t immediately return a request for comment.

The alleged West Side bike-path terrorist told a Manhattan judge on Friday that “Islam is leading a war,” and said he could only be judged by Allah.

As a hearing was wrapping up, Sayfullo Saipov, who could face the death penalty for mowing down dozens of pedestrians and bicyclists with a rented Home Depot truck, killing eight last Halloween, raised his hand in the air to speak to Manhattan federal Judge Vernon Broderick.

Saipov, 30, said through a translator :mad:, “The judgments made here are not important to me because they are judgments of living things . . . not by Allah, made by weak minds.”

Broderick interrupted Saipov to tell him his statements can be used against him at trial.

Saipov responded, “I understand you, but I’m not worried about this at all.”

He continued, “Islamic State, in order to impose Sharia on Earth, is leading a war. Islamic State is not fighting for land, as some say, or oil. They have one purpose. It’s fighting to impose Sharia on Earth.”

Earlier, Saipov pleaded not guilty to a superseding indictment that added attempted murder and assault in aid of racketeering charges to his case.

Manhattan federal prosecutors say they’ll seek the death penalty for “bike path terrorist” Sayfullo Saipov, who stands accused of killing eight people in an ISIS-inspired attack in lower Manhattan last year.

In a five-page memo released Friday, prosecutors said they have determined “a sentence of death is justified” if Saipov is convicted at trial. They cited Saipov’s “lack of remorse” and “future dangerousness,” saying he continues to support ISIS from prison.

Saipov, 30, was arrested last year for using a Home Depot rental truck to drive through a crowded bike path on Halloween in what the feds claim was an ISIS-inspired attack.

Prosecutors said the Uzbeki immigrant asked to fly an ISIS flag outside the hospital room where he was brought after being shot by cops. FBI agents also found ISIS propaganda on his phone, including videos of ISIS fighters “killing a prisoner by running the prisoner over with a tank,” and “a video of a beheading,” they said.

Saipov’s court-appointed lawyer, David Patton, said in a statement that “the decision to seek the death penalty rather than accepting a guilty plea to life in prison with no possibility of release will only prolong the trauma of these events for everyone involved.”

If the judge OKs the death penalty, a jury will decide whether to impose it at trial.

Statements the alleged bike-path terrorist made to the feds while he was in the hospital recovering from a gunshot wound shouldn’t be admitted at trial because he was on heavy pain meds at the time, his lawyers argued in new court papers filed today.

Lawyers for Sayfullo Saipov — who allegedly drove a truck down a crowded Manhattan bike path, killing eight people, two Halloweens ago — say federal agents conducted an interview with him that lasted all night on the same day he was operated on at Bellevue Hospital.

Since the FBI agents, “interrogated Mr. Saipov while he was still under the effect of powerful opioid and benzodiazepine sedatives, Mr. Saipov’s statements were not voluntary,” lawyer David Patton wrote in Manhattan federal court papers.

Saipov was shot in the groin by cops on the day of the attack.

His lawyers also say the feds seized his cellphones unconstitutionally and information from them shouldn’t be allowed at his October trial.

A judge pushed back the trial for West Side “bike path terrorist” Sayfullo Saipov on Tuesday, giving his family another six months to try and arrange visas to see the feds make their case against the man accused of driving a truck down a crowded bike path on Halloween 2017, killing eight people.

Saipov’s lawyer, David Patton, asked for the extension to allow the accommodation for Saipov’s family and also so that defense lawyers can continue to sift through the mountain of evidence that prosecutors have compiled against him.

Manhattan Assistant US Attorney Matthew Laroche argued that Saipov should only get an extra month extension because “the families of victims and victims have expressed the desire to move the trial along as quickly as possible.”

Laroche added they “have been waiting years for justice.”

Patton said having Saipov’s family present at trial is important because ”their mutual love for one another says something about the possibility of redemption in this life.”

Manhattan federal Judge Vincent Broderick granted the request Tuesday pushing the trial date from October to April 2020.

Saipov, 31 — who is originally from Uzbekistan — faces the death penalty if convicted at trial for the ISIS-inspired incident from two Halloweens ago when he allegedly drove a rental Home Depot truck down a bike path on the West Side of Manhattan injuring dozens of people and killing eight.

The ISIS-inspired man who is accused of killing eight people in a Halloween 2017 terror attack by driving a truck down a crowded bike path along the West Side Highway in Lower Manhattan was being watched by the government for years before the attack, according to a new court filing.

A lawyer for Sayfullo Saipov, who faces the death penalty, argues in a heavily-redacted Manhattan Federal Court filing submitted by his lawyers on Monday that prosecutors should turn over information about surveillance of their client’s conversations with two unnamed associates.

The government listened in to one of Saipov’s conversations with one of those associates as late as Oct. 30, 2017 — one day prior to the attacks, the filing states. In November, it was revealed that the government had been recording Saipov’s conversations with the associates for clues as to his finances, contacts and potential exposure to material from the Islamic State.

The government “must disclose any materials revealing Mr. Saipov’s alleged connection to ISIS so that he may adequately prepare for trial and a potential penalty phase,” argues Andrew Dalack, a member of Saipov’s court-appointed defense team, in the new filing.

Prosecutors do not intend to present evidence gathered through surveillance of Saipov at his trial, which is scheduled to begin next year. Additionally, prosecutors oppose releasing information about its surveillance of Saipov prior to the attacks, saying he was never an investigative target.

But such information could be helpful to Saipov because, if those associates or other friends of Saipov who are suspected of having sympathies for Islamic extremism had influence over the accused mass murderer, a jury may find that the other parties share the blame for the deadly attacks and decide to spare him from execution.

Accused bike path terrorist Sayfullo Saipov told a Manhattan federal court judge Monday he doesn’t respect his authority — while prosecutors said they want to empanel an anonymous jury to oversee the death penalty case.

“The orders issued here have nothing to do with me,” Saipov told Judge Vernon Broderick through an Uzbek interpreter. :mad: “I am following orders of Allah, who gave me life.”

The comments followed a hearing regarding jury selection ahead of the alleged ISIS militant’s trial for driving a truck down a crowded bike path on Halloween 2017, killing eight people.

Saipov stood as he spoke, wildly gesticulating as he asked Broderick why he was sitting in judgement of him “for the eight people killed” and “not those who are killing thousands and millions of Muslims over the world.”

Broderick eventually cut off the 31-year-old, and told him a judge’s role was more like that of a “referee.”

“I recognize that you don’t recognize me, or recognize my authority,” Broderick added. “This isn’t the time or place to be making statements.”

Meanwhile, Manhattan federal prosecutor Matthew Laroche said the government plans to seek an anonymous jury to sit on the case.

Defense attorney David Patton said his team would be opposing that request.

Broderick has yet to rule on the issue.

Saipov’s trial is scheduled to kick off April 13, 2020.

Accused bike path terrorist Sayfullo Saipov threatened to decapitate a federal corrections officer for repeatedly waking him while he’s locked up at the Metropolitan Correctional Center, a new court filing detailing a trove of the government’s evidence against him alleges.

Saipov, who’s accused of killing eight people during his 2017 Halloween terror attack on the West Side Highway, allegedly threatened the officer on Dec. 17 last year for repeatedly slamming a door at night, making it hard for the ISIS follower to sleep, the filing states.

“During the course of this confrontation, the defendant threatened to kill the Officer. Indeed, as the defendant later admitted to the MCC’s disciplinary committee (the ‘Committee’), he told the Officer that if the Officer dared to open the defendant’s cell, in two minutes ‘other guys will be picking up your dead body,’” the filing states.

The next day, still angry from the prior incident, Saipov obstructed a security camera in his cell and said he wouldn’t remove it until “the Officer’s head was cut off” and then referred to the officer “as an animal,” according to the filing.

“Again, the defendant unapologetically admitted this threat to the Committee, telling the Committee that he wanted to ‘cut this animal head off,’” prosecutors allege.

The government’s motion, filed late Tuesday, describes all of the evidence it plans to introduce in Saipov’s April trial and all of the items it wants the court to exclude.

It plans to call on some of Saipov’s 11 living victims, some who were permanently disfigured following the attack, and will include the never-before-seen note that Saipov allegedly left at the scene.

The note, pictured in the motion, is a crudely drawn image showing three renditions of the ISIS flag as well as three sets of the same Arabic text, which roughly translates to “No God but God and Muhammad is his Prophet” and “Islamic Supplication. It will endure,” a phrase “commonly used to refer to ISIS,” according to prosecutors.

Saipov, an Uzbeki immigrant, faces the death penalty if convicted.

The ISIS-inspired terrorist who killed eight people by ramming into them with a truck on a West Side Highway bike path in 2017 was convicted of a slew of terrorism and murder charges by a Manhattan federal jury Thursday.
The panel’s conviction of Sayfullo Saipov, 34, on 28 counts paves the way for the death penalty phase of the trial to begin — when jurors will decide whether he should be put to death for the murderous rampage.
The panel of three women and nine men deliberated for about six hours before returning the verdict to Judge Vernon Broderick.
The death penalty phase of the trial is tentatively scheduled to begin on Feb. 6.
Saipov, an immigrant originally from Uzbekistan, did not show emotion as Broderick’s courtroom deputy read the verdict aloud.
The terrorist, sporting a long, black beard and wearing a black suit, sat at the far end of the defense table, listening to a translation of the verdict that was beamed into headphones he was wearing.
Over the course of the two-week trial, victims who survived the attack described the horrific and violent scene after Saipov, driving a rented flatbed truck, plowed into as many people as he could in Lower Manhattan on the afternoon of Halloween that year.
Family members described from the witness stand how they watched as loved ones struck by the madman were left bloodied on the bike path and ultimately died from their injuries.
One victim who was killed, Ann-Laure Decadt, had been riding a rented bike with family members who traveled from their native Belgium for a New York vacation to celebrate a number of milestone birthdays.

The surviving members of the family testified they heard the horrific sound of an engine on the path behind them just before Ann-Laure was struck.


Seconds later, they saw her lifeless body on the ground, the relatives testified.


“Her gaze was lifeless,” her sister Friedel testified. “She just stared up into the air, and there was lots of blood gushing out of her mouth.”


In their opening and closing arguments to the jurors, federal prosecutors described the grisly violence, but also repeatedly told them Saipov carried out the attack in an effort to join ISIS.

“The Islamic State shall endure,” Assistant US Attorney Jason Richman said in his closing statement Tuesday. “These were his words to tell the world why, why he attacked this city, why he targeted innocent civilians, why he turned a bike path into his battlefield, why he ran them over without mercy.”


“The defendant caused all of this death and destruction to become a soldier of the caliphate, a part of ISIS. The Islamic State shall endure,” he added.


Of the 28 counts of which Saipov was convicted, nine carry a potential death sentence.

The trial in the coming days will enter the “penalty phase” during which Saipov’s defense attorneys will likely call witnesses in an attempt to humanize him and lobby the jurors to spare his life.


During the guilt phase of the trial, attorney David Patton argued Saipov was inspired by Islamic State propaganda and a radical interpretation of Islam — but that he did not carry out the attack in an effort to join the terror group.


Saipov intended to be killed and to ascend to heaven as a martyr after the attack, Patton told jurors.

“If you commit an attack and you are planning to die, you are not planning on joining an organization. You are not planning to become a member of any organization,” Patton said in his closing statement.


Patton did not dispute that Saipov had committed the attack, but focused on prosecutors’ allegation he did so to join ISIS because that claim is at the heart of nearly all the charges he faced.


Saipov was charged with 26 federal racketeering charges for carrying out the attack in an attempt to join ISIS. Eight of those racketeering charges carry a potential death penalty.


The final count he was charged with, destruction of a motor vehicle that caused death, also carries a potential death penalty sentence.

West Side Highway terrorist Sayfullo Saipov will serve life in prison after a Manhattan federal court jury could not unanimously agree to sentence him to death for killing eight people and wounding several others in an ISIS-inspired rampage.
The jury’s failure to reach a unanimous verdict — necessary to impose the death penalty — on Monday ended a dramatic, monthslong trial that saw surviving victims tearfully testify about the horror of Saipov’s attack and his family members urge jurors to spare his life.
The panel weighed the penalty for about 10 hours before telling Judge Vernon Broderick they were deadlocked Monday afternoon, the second full day of their deliberations.
As Broderick read the lengthy verdict sheet Monday, Saipov showed no visible emotion while listening to a translation through headphones provided by the court.
A formal sentencing date has not yet been set.
Saipov was convicted in January of fatally mowing down eight people along a West Side Highway bike path on Halloween 2017 in a rented Home Depot truck.
During the penalty phase of the trial, prosecutors questioned a host of witnesses – including surviving victims and family members of those slain – to show jurors the horrific violence carried out by Saipov.

Assistant US Attorney Alexander Li told jurors during the guilt phase of the trial that Saipov smiled, gave a “proud confession” and requested an ISIS flag to hang in a hospital room where he was being treated after the attack.


The prosecutor then described the horror on the Lower Manhattan bike path that left eight people dead on the afternoon of Oct. 31, 2017.


“It was a scene of destruction and horror. Mangled bicycles covered the path. The riders — human beings — lay unconscious or dead. Survivors staggered around, wounded and dazed, searching for family and friends,” Li said in his opening statement.

“Screams filled the air,” he added.


The jury convicted Saipov on 28 counts — nine of which carried the possibility of the death penalty — hours after they began deliberations on Jan. 26.


The conviction triggered the penalty phase of the case – which functioned like another full trial, where prosecutors and defense attorneys questioned witnesses, presented evidence and delivered opening and closing arguments.

During the penalty phase, family members of those killed described in painstaking detail how they’ve been devastated by the loss of their loved ones.


The emotional testimony was referenced in prosecutors’ dramatic closing argument on March 7 as they urged jurors to condemn Saipov.


“The defendant caused unbearable pain to these families. They are still suffering,” Assistant US Attorney Amanda Houle told jurors in her closing.


“Has the government proven aggravating factors that show that the way that this defendant chose to commit murder, by terrorist attack and the unremorseful slaughter of innocent civilians. Does that make his crime worthy of a harsher penalty?” Houle asked jurors.


“The evidence shows overwhelmingly that it does,” she said.

Houle then described the testimony jurors had heard about how families of the slain victims had been upended by the terrorist attack.


Victim Nicholas Cleves’ mother, Monica, told the panel she couldn’t put her grief into words, Houle said.


“Monica said there are no words in the human language that can adequately describe the excruciating pain that ‘seared, that consumed me and has never left me since.’ She said all of the enjoyment and connection with life she used to have has been stripped away,” the prosecutor said.

“Maria Alejandra told you how Amber and Mora have struggled since their father’s murder,” Houle said of another family devastated by the loss of a loved one.


“How they feel his absence constantly, how Amber was hospitalized on Father’s Day after having chest pains in the middle of the night, how the girls couldn’t sleep alone for years, and how they miss kissing him at night, so they kiss his urn of ashes instead,” she said.


Saipov’s defense attorneys had sought to humanize him by questioning his family members on the stand, most all of whom broke down in tears when they told the jury they still loved him — despite what he had done.

The defense’s penalty-phase case reached a dramatic peak when his father, sobbing uncontrollably, told jurors he still loved his son “with all my heart” from the witness stand.


The testimony prompted Saipov’s uncle, who was seated in the gallery of the courtroom, to stand up and begin shouting in Uzbek.


“Dirty ISIS bastards!” the man yelled in Uzbek before slamming his fist on a courtroom door and walking out of the room.

In an impassioned closing argument, Saipov attorney David Patton repeatedly told jurors they face a “unique, individualized, moral decision” in whether or not to sentence the terrorist to death.


“That is an awesome responsibility and power, and we are asking you to decide for life, to decide that the appropriate moral decision here is life,” Patton said.


“It is not necessary to kill Sayfullo Saipov, not for our safety or anyone else’s and not to do justice,” Patton said.





The jury unanimously found the existence of 26 so-called “mitigating factors” that they were instructed to consider when establishing a sentence of life or death.


The factors included evidence presented by the defense at trial, including that he’ll be locked up in the nation’s most-secure prison facility in Colorado for the remainder of his life.


The jury also found that Saipov’s life had meaning to his family members, many of whom traveled from Uzbekistan to testify at the trial.


All 12 panelists agreed with mitigating factor No. 24, that he has three children who still love him.
