12-Year-Old Sodomy Suspect Released
HOUSTON -- A 12-year-old boy accused of attacking and sodomizing an 8-year-old boy with a stick was released to family members Wednesday, KPRC Local 2 reported.
The 12-year-old was charged with aggravated sexual assault of a child. Investigators said he was angry about a neighborhood football game when he pulled the 8-year-old behind their Brookshire apartment building, forced him to the ground, pulled down his pants and attacked him.
The 12-year-old spent about two weeks in a juvenile county boot camp following his arrest.
At a detention hearing Wednesday, the judge released the boy to a
relative in Katy with conditions until his trial is held in five months. He was ordered to not return to Brookshire.
The 8-year-old's mother was shocked that the boy was released.
"They don't think he's a risk to anyone else and they let him go. They let him go," the mother said. "Children are not safe in Katy as long as there's people like this running around. They're not going to be safe and we have traditional systems that are letting them go after they're committing crimes."
The 8-year-old told KPRC that the Brookshire police helped him by putting the 12-year-old in jail.
"Then, I won't get hurt or nobody else (will) get hurt again like this," the boy said.
The 8-year-old's mother believes the judge is sending the wrong message by releasing the boy.
"It's OK. It's OK but mommy will come bail you out. That's the message that was sent today. There's no justice at all -- none," she said.
The judge had several options, including releasing the boy,
having him remain in boot camp with a review every 10 days, giving temporary custody of the child to a relative outside of Brookshire and not allow him to return to Brookshire, or have him electronically monitored.
The suspect's family attended the hearing.
The boys live in the same Waller County apartment complex and attend the same school.
